November 2000 <br /> Page 6. <br /> Ms Boretos asked how long this will take? Mr. Santos advised there is a letter of commitment in <br /> the file now that it will be constructed. They want to construct the building and septic and <br /> remove the two buildings in the velocity orae,now,before next season. <br /> Mr. Rosenberg wanted a letter stating they wih build it, whether or not they get State funding <br /> and that the pumping station will be installed by a certain slate. <br /> Ms Boretos stated there could be a condition that they will install a tight tank at the same time. <br /> The Chair thought this was the right way for it to be done. <br /> Mr. Rosenberg stated he would be prepared to move that the hearing be closed if the Order of <br /> Conditions contained a fixed obligation, based on a commitment in writing from the applicant, <br /> that the pump-out station,as described, would be installed by such and such a date. <br /> The Chair asked if it is legal to tack something on an Order such as this. Mr. Rosenberg stated it <br /> 1s. <br /> Mr.Santos stated that has been clone before at the MacDougall ougall Marine in Falmouth and Kingman <br /> Marine in Bourne, as part of the condition that within a period of time the construction will b <br /> completed. He agreed that would be fine. He will have a letter re-written stating the <br /> commitment and the date. <br /> Dick York, Shellfish Warden, was present to support the pump-out station and tight tank. He <br /> stated he was not comfortable with the letter either. <br /> Public comment: none. <br /> VOTE: Motion made and seconded to continue the hearing at the request of the applicant to <br /> 16 November 2000 at 8:15. Unanimous Note. <br /> HEARING CONTINUED. <br /> 7:50 FRED LU NI,116 P ppon sset Island Road,continued from 19 October 2000. There was <br /> no one present to represent the applicant. <br /> Ms Boretos advised she and Mr.Sherman met at the site with Brian Casey. <br /> VOTE; Motion mach and seconded to deny the application unless within five days a request <br /> is received from the applicant for a continuance to 30 November 2000 at 7:15 p.m.' <br /> Unanimous Vote. <br /> HEARING NTI UED. <br /> 7:55 RONALD CAHILL for a Determination of Applicability on a proposed three season room <br /> over an existing deck and proposed deck extension at 14 Heron way. Ron Bale was present. <br /> Ms Boretos stated this is all within the same footprint. She recommended negative 3. <br />
