14 December 2000 <br /> Page 7. <br /> Mr. Johansen stated this has already gone through before. <br /> Mr. Sherman stated if it gent through before, there are still several <br /> aspects of it now that need looping at. Back then, we may have erred <br /> and not considered it properly. There are legitimate issues about <br /> whether or not it meets the performance standards and resource areas <br /> not being correctly identified. He has questions about the p fan itself and <br /> how it was generated. <br /> Ir. Hayes asked to let hire address those questions with a presentation. <br /> Ms Boretos recommended to the Commission that they need to get input <br /> from CZM and the information submitted in the Notice of Intent and <br /> plans before the Board do not show how they have overcome the Burden <br /> of Proof under 10.03. How is this project going to protect the eight <br /> interests under the Wetlands Protection Act? Mr. Hares - stated h <br /> cannot answer that until he gives his presentation. Ms Boretos stated <br /> that information was supposed to be in the Notice of Intent. Unde'r Form <br /> 3, they aro supposed to supply enough information and details and <br /> accuracy of the resource delineations to address things life 10.03. <br /> Mr. Hares stated they gave exactly what was required from the Town and <br /> from the previous application which is exactly the sane. Mr. Sherman <br /> stated standards have changed for plans. Mr. Hayes stated his plans are <br /> as good as anything the Commission has and he would life to present <br /> them. <br /> Mr. Sherman stated the point Mr. Hares made earlier about CZM review <br /> not being required is correct. However, -under the Bylaw and the State <br /> Act the Commission'bias the right to ask for other opinions and to gather <br /> information deemed necessary to render an appropriate decision. <br /> .Mr. Hayes inquired who did the Commission ask? He advised that he <br /> met with 'T'ruman' Henson and Rebecca Haney yesterday. This Notice e of <br /> Intent was sent by Certified Mail, not to Truman or Rebecca, but to <br /> Wendy Quigley, who hasn't a clue......Ms Boretos stated she would not <br /> allow him to slander somebody's professional ability. <br /> Mr. Hares stated the expertise in this town is so much more valuable <br /> than Assistant Geologist's expertise who -is not as familiar with that <br /> beach. He does not see that this should delay this. <br />
