The Chairman recognized ,Attorney Paul wrghtman, representing <br /> Applicant ; a s well a Paul iel, Surveyor. <br /> Michael Talbot made inquiries regarding the base map being <br /> presented to the Commission. <br /> Mr. Rielreplied, "The basemap is from X991, the elevations <br /> and the soundings are as of May, this year. We have found that <br /> in 1991, 1992, 1999, 2000, and 2001 there have not been any <br /> changes at all that make a huge bit of difference. The only <br /> change that we noticed was the change of the small piece of salt <br /> marsh that ' s right down here. Mx. Sherman, the Conservation <br /> Agent was out there with us and said "Yes. ,, that. . .pointed out <br /> the corners that we could use now, and that ' s the only change out <br /> there. " <br /> Mr. I iel continued to report on changes in soundings, being <br /> deeper by two inches in depth, due to storm conditions . <br /> Michael Talbot then questioned the indication of "edge of <br /> creek" making the point it no longer exists . <br /> Mr. Riel made reference to the Plan, noting an old Land <br /> Court Plan indication of "edge of creek" which is currently <br /> considered to be a property line. <br /> At this point Mr. Sherman informed the Commission that he <br /> has made an on-site and has verified staking for -access of the <br /> dock. He has also spoken with the Shellfish warden, who is <br /> present and prepared to deliver his Report . <br /> The Chairman recognized Rick York, Shellfish Warden who <br /> acknowledged the revised plan being submitted shows the two foot <br /> below mean low water contour, as he had previously requested. He <br /> then made reference to said revised Plan, dated May 25th, stating <br /> he has made an on-site. References were being made to the <br /> sloping shoreline, contour line, and depth soundings . He noted <br /> the depth soundings are beyond the contour line, informing the <br /> Commission that upon measurement he found the two foot contour <br /> to be farther out than indicated on the Plan. <br /> Ir. York reported this area to be a prime shellfish habitat, <br /> that the floats located in the shallow water (less than two feet <br /> deep) ill -bottom out at extreme low water which could create <br /> negative impacts to shellfish productivity by crushing newly set <br /> larvae. <br /> Mr. York requested elimination of the inside float, <br /> replacing it with a ramp or walkway, which would come out to the <br /> two foot contour and at which point shellfish would not be <br /> disturbed, which would also eliminate the possibility of further <br /> negative impacts due to boats being tied up in the shallow water. <br /> -12- <br />
