Mr. York stated the above to be hi,s major concerns. <br /> Mr. Riel explained to Mr. York' s satisfaction how the <br /> contour line had been calculated. <br /> Mr. York reiterated the fact that the inside float does <br /> extend into shallow water; and that gore is quite a drop off <br /> at that point . He again stated the concern being with the inside <br /> .oat, as well as any boats that may possibly be tied up therebottoming out, resulting in negative impacts to shellfish. <br /> Attorney Wi ghtman stated this matter~ to be an Amended Order, <br /> the original having been issued sore time e ago. He questioned <br /> whether or not raking a substantial change to design would <br /> necessitate a new process . Applicant proposed the amendment to <br /> the original order of Conditions based one location, here being <br /> no shellfish issues raised three years ago (ZBA Special. Permit) . <br /> (It was determined the original Order was issued on 10/22/92 <br /> with an Amended order on 09/07/95. ) <br /> Mr. York commented that 'his predecessor had commented in <br /> 1992 (which can be substantiated in the Record) that the water <br /> was too shallow for a dock and recommended float <br /> stops dor <br /> elevation. He suggested another~ option would be to install float <br /> stops on the back of the float to keep it two feet off the <br /> bottom. Again, expressing concern for any boats being tied t <br /> the dock.. <br /> Mr. Riel stated the current design was done so by Committee. <br /> The original walkway was proposed at five feet move the marsh, <br /> the Conservation Coz ission requested 'everything be brought down <br /> to water level . {The Conservation Agent had no recall of this <br /> statement . <br /> Mr. Sherman stated thepurpose -of this discussion was to <br /> lessen impacts, not to make difficulties for tApplicant; <br /> acknowledging validity of the Shellfish warden t s comments. The <br /> `own Regulations provide that Amended orders or Extensions are <br /> subject to review. He agreed if raising the float would lessen <br /> impacts, it should be dome, and that it could be done within the <br /> cope of the Amended Order. <br /> Attorney i gh tr an agreed with the Shellfish Warden' s <br /> suggestion to install float stops to the back of the float. <br /> Mr. Sherman suggested a Condition prohibiting boat tie up t <br /> the inside of the float . <br /> In response to concerns raised by Attorney Wig tman, Nor. <br /> Rosenberg stated all Conservation Commission votes are subject to <br /> Zoning Board of Appeals approval. . <br /> -13- <br />
