Attorney Wightman stated for the Record and for benefit of <br /> the abutters, the original order cannot be appealed. <br /> The Chairman recognized the Assistant Conservation Agent who <br /> asked if Applicant is aware of Chapter 91 - pilings; to which <br /> Attorney wightman responded in the affirmative. <br /> The Chairman recognized the following members of the public <br /> for comment : <br /> Nancy Caff n protest d, stating her objections and <br /> recognizing this property to be one of the last nice coves being <br /> used by the public for claming which should not be disturbed in <br /> her estimation. she stated the Conservation Commission should be <br /> responsible to protect the clamming beds. she provided pictures <br /> of Fifth Grade Students clamming; made reference to the 'down <br /> Report; noting the water limitations in the area; and made <br /> reference to the stakes. She feels certain boats will be tied exp <br /> along the sides of the dock. i <br /> She posed two questions . The 'plans refer to Chris Burden as <br /> a property owner, which she challenged. The current owner being <br /> Icon. She stated the plan is old, and feels it has not been <br /> properly updated, and questioned the appropriate size of the cove <br /> as it is depicted. <br /> She asked if the proposal has been presented to the <br /> Waterways Commission and was told by Applicant , s representatives <br /> that it has . <br /> Ms . Caffyn then grade reference to the iegfried- property <br /> being impacted the most by this proposal identified as Lot-C on <br /> the Plan) . She stated there is no interest on the part of this <br /> property owner in the dock; that he had been intimidated; and has <br /> stated to her that he does not want the dock. ,It was a decision <br /> where he went to court for three years, it was indicated that <br /> perhaps Mr. Blythe has influence in the Town, and it could be <br /> passed through. " she feels this is an issue, stating the dock <br /> itself is impacting her neighbor dramatically. <br /> Ms. Caf fn stated- this has been a public use for the last <br /> fifty 0 ,or sixty (60) gears . . . it is a public area. <br /> The Chairman interjected that the property is privatel y <br /> owned; to which Ms . Caff n stated she was unsure. <br /> Letter Board of Assessors 1981 "In looking up Parcel B <br /> we could not find out where this parcel and other three parcels <br /> were coming from. In the past these properties were a creek with <br /> flowing water. This office needs more information. who filled <br /> it in to create upland id the Mate of Massachusetts have an <br /> interest? If you have more information, please forward it to the <br /> above office . ', <br /> -14- <br />
