ms . caffyn quoted the Board of Assessors having stated in 1981, there wasn' t even existing land where there is currently approval for construction of a dock. The Commission determined an Attestation of ownership would be required in this matter, obtained from the Town Clerk' s Office. Mr. Sherman clarified the dock structure will impact only Applicant ' 'property, and Commonwealth tide land. Ms. Caffyn uestioned _le al title ownership of the property: to which Mr. Sherman responded this body .unable to adjudicate that particular question. Ms . Caffyn requested the Commission obtain an Attestation of ownership, as she feels this issue is of critical importance. Mr. Rosenberg interjected that any questions of ownership should be presented to the Board of Assessors for determination. Mr. Sherman further clarified the Attestation of Ownership form may be filed at any point during the process, the Conservation Commission cannot however issue until it has been received. Mr. Sherman stated that upon submission of a completed Attestation of ownership for t, and Applicant ' s agreement to use float stops as required by the shellfish warden, the Commission should Close and Issue. Ms. Caff n mentioned a right of way for members of the public walking the shore/clamming, asking whether the dock would prove to be an obstruction. Nor. Sherman referred her to the Zoning Board of Appeals and to Chapter 91 . Mr. Sherman assured the Shellfish warden that the Commission would impose tie standard Condition with reference to boat (s) being moored at the dock. There being no further Commission or public cors e t, the Chairman entertained a motion. MOTION.- John Johansen made a Motion to Close, subject to receipt of Attestation of ownership and construction of float stops to the dock; which motion was seconded by Ralph Shaw.
