evegetatio Plan as shown. <br /> There being no Commission or public input, the Chairman <br /> entertainers a motion. <br /> i L <br /> MOTION: Carol Moore made a Motion to approve the amended <br /> Order of Conditions and Revegetation Plan as shown, which lotion <br /> was seconded by Ralph Shaw and so voted unanimously. <br /> Ton-Hearing Agenda-Continued <br /> Brian Handy-Farley Bog <br /> The Chairman recognized Brian Handy who stated he was <br /> present to respond to a letter received from the Conservation <br /> Agent, which letter had been approved by the Conservation <br /> Commission. <br /> Mr. Handy informed the Commission that said letter was not <br /> well received and he requested an opportunity to address the <br /> issue. He explained the project to be a reservoir within the <br /> Farley Bog. Approximately two years ago he informed the <br /> Conservation Agent and Chairman of the Board of Health that the <br /> wells were failing and of the necessity to locate a water source. <br /> He suggested a specific area in the wetlands behind the pump <br /> house, to which the Conservation Agent allegedly agreed. The <br /> Assistant Agent thereafter flagged said area. Nothing further <br /> was done. <br /> Mr. Handy reported he conducted an on-sate visit this fall <br /> with N CS who suggested the flat area having already been <br /> excavated for sand might be the better area choice; to which Mr. <br /> Handy agreed. He stated he had informed the Conservation Agent <br /> who in turn requested a plan be submitted. Said plan having been <br /> prepared by lir. Liptack and presented to the Conservation Agent. <br /> N±, Handy further reported that approximately one month <br /> later work had been dommenced. Trees were curt and a reservoir <br /> was excavated. At this point Mr. Dandy was oonta ted by a <br /> representative of the Falmouth Rod & Gun Club (hereinafter <br /> referred to as "F GC) suggesting he had trespassed onto their <br /> property. He responded by obtaining maps of the property and <br /> confirmed that the clearing had been conducted on Mashpee Town <br /> owned property, however~ had he proceeded with the project, he <br /> would have encroached onto property owned by the C. At this <br /> point all work came to a halt, all as relayed by Mr. Handy. <br /> The property boundaries have sine been staled out by an <br /> engineer hired by Mr. Handy, a new reservoir site has been <br /> suggested and which is located within the confines of Town of <br /> ashpee owned property. <br /> Mr. Sherman asked for clarification i f, after the property <br /> was surveyed .it has been established that 1 .
