DiGregorio reiterated only the lower section of Quaker <br /> Run is being determined; the upper areas are currently flowing <br /> due to the considerable amount of rainwater. <br /> Mr. Sherman clarified if the Commission agrees to make a <br /> determination on the upper portion as requested, the other areas <br /> remain in abeyance to be resolved at some future point . <br /> Nor. DiGregorio responded the matter would be resolved by a <br /> Notice of Intent filing. He intends to monitor the upper areas <br /> of Quaker tun throughout the summer and to provide photographs. <br /> (Diane Boretos suggested the study of invertebrates might also be <br /> helpful . ) <br /> It was determined that should this decision be rade, it <br /> would remain in effect for three years. If necessary, the <br /> Town ]BY-law could be amended. <br /> There was discussion regarding criteria similarities and <br /> differences between the Freezer Point location in Barnstable <br /> Harbor and the Ma pee location. Mr. DiGregorio stated an <br /> attempt was made to intertwine Masbpee regulatory language with <br /> the Freezer Point Decision. Mashpee sampling criteria was used. <br /> Mr. Sherman recommended the Commission adopt the BVW <br /> delineation determined by Ms . Fantozzi for the upper abandoned <br /> bog; accept what is being presented as the southern portion of <br /> the Riverfront area (125 ft. from the fish weir) , pending a site <br /> visit; everything else to be held in abeyance until a Notice of <br /> Intent is filed. <br /> References were being made to the map regarding the area <br /> identified as "tidally dominated" being the non-riverfront area; <br /> transition area; tidally influenced area-50% mark. <br /> Mr. Sherman clarified the northern boundary of the southern <br /> portion of the area is not being defined at this Hearing. <br /> Applicant is requesting the Conservation Commission concur with <br /> their findings, the southern most extent of Riverfront area is <br /> one hundred twenty-five ft . ) feet north of the fish weir. <br /> Mr. Sherman recommended the connission close and accept <br /> the interpretation presented, pending a site visit to the one <br /> hundred twenty-five 125 ft. ) foot station; reprised plans are <br /> submitted clarifying the southern most terminus of the Riverfront <br /> area. <br /> Michael Talbot stressed the importance of a site visit to <br /> the one hundred twenty-five 125 ft . ) foot mare. <br /> Carole Moore expressed her concern for the 11 interpretation" <br /> of the data presented as being conclusive. <br />
