Having discussed the natter with the <br /> Conservation Agent, she recd nend.ed approval . <br /> "here being no further Commission or public comment, the <br /> Chairman entertained a motion. <br /> MOTION: Ralph Shaw made a motion for Negative III <br /> Determination; which Motion was seconded by Carole Moore and so <br /> voted unanimously. <br /> 7 : 40 Prime Properties Realty Trust for Determination of <br /> Applicability on proposed construction of a 121 x 261 deck; and a <br /> 101 x 31 high retaining wall; and addition of fill within the <br /> work area at 135 Surf Drive, Assessors map lot; Block 3 . <br /> The Chairman recognized Ken Marsters, who provided copies of <br /> the Plan. <br /> r. marsters, explained that he had inadvertently neglected <br /> to include a deck within the plan when he originally appeared <br /> before the Commission to obtain a Notice of Intent . <br /> The Plan has since been amended to include said, deck. Upon <br /> inspection of the property by the Conservation Agent, it was <br /> discovered that the garage had been constructed where the family <br /> room had originally been proposed, which resulted in an eight <br /> ft. ) foot gall being exposed. Sufficient fill_ was brought in to <br /> create a driveway. Construction of a retaining wall is being <br /> requested to contain the fill, a berry will also be constructed <br /> with native inkberry plantings. <br /> Nix•. marsters indicated the proposed location for drainage, <br /> stating drywell.s will be constructed at every downspout from the <br /> douse in order to protect the wetland area. <br /> Diane Dor tos recommended a Negative III Determination.
