RDA Elliot Rosenberg reported upon a conversation held with the Conservation Agent earlier this date. An Enforcement order has been issued for the replacement of trees which had been removed without benefit of a permit, and which had been discovered by an on-site inspection. The Revegetation Plan referred to in the Application has not yet been received. Applicant is not in compliance as he has refused, upon notification, of the necessity of a continuance of the Hearing with the Commission. Mr. Rosenberg suggested a Positive Determination be considered by the Commission as there is no one present on Applicant ' s behalf. John Johansen pleaded with the Commission to allow him t amend the Application to the RDA initial/sign) on Applicant ' s behalf, therefore allowing further• consideration by the Commission. The Commission ion agreed Mr. Johansen could represent the Applicant in this matter, as he had assisted the Applicant with the initial paperwork. There being no Commission or public comment, the chairman entertained a motion. NOI The Chairman recognized John Bresnehan, representing the Applicant. Mr. Bresnehan informed the Commission Applicant is requesting approval to continue work proposed in developing three golf holes on the property. Proposed work had begun under a previous Notice of Intent. There has been extensive communication with the Assistant Conservation Agent both in the field and in meetings for the design of said golf doles in an attempt to respect the resource arca. Overflight areas have been created over the wetlands. Also, quite a lot of over wintering habitat has been created,
