requesting a four week continuance. <br /> MOTION: Elliot Rosenberg made a Motion to continue the <br /> Hearing in this matter~ to October 4, 2001 at : oo p.m. at <br /> Applicant ' s request; which Motion was seconded by Michael Talbot <br /> and so voted unanimously. <br /> azole Moore arrived at the Meeting at this point - : 00 <br /> P.M. <br /> Non-Hearing Agenda - old Business continued <br /> . MMR wetland Determination for site SD- - Diane Bofetos <br /> reported there has been uncertainty as to whether or not the site <br /> under discussion is wetland. MMR has hired a consultant to <br /> conduct a wetland survey, which report states it is not a -wetland <br /> area; to which the Conservation Agent agrees . It is a Swale with <br /> upland species, no longer connected to Ashur et Pond. There is no <br /> jurisdictional issue at this site, <br /> MOTION- l l iot Rosenberg made a Motion to accept the <br /> Wetland Survey and the Conservation Agent ' s determination there <br /> are no jurisdictional issues in this ratter; which Motion was <br /> seconded by Ralph Shaw and so voted unanimously. <br /> New Busies <br /> 1 . Enforcement order-212 Wheeler Road - Diane Boreto <br /> reported she been notified of significant cutting at this <br /> site. Upon inspection she found that several large beech trees <br /> had been topped off (approximately ten feet above grade) by the <br /> current owner in order to provide a view. <br /> An Enforcement order has been issued requiring an inspection <br /> and recommendations from a certified Arborist regarding <br /> Litigation/restoration; as well a to provide documentation <br /> regarding impact. <br /> Leonard Pinaud suggested replanting replacing the trees with <br /> sizeable beech trees. (Some ethical questions were raised with <br /> regard to consulting arborist. ) <br /> Elliot Rosenberg suggested the property owner be referred t <br /> the American society of Consulting Arbo `ist s; to which the <br /> ommi s s i on agreed. <br /> MOTION: Elliot Rosenberg rade a motion to approve the <br /> Enforcement order with, respect to 212 Wheeler Road; which Motion <br /> was seconded and so voted unanimously. <br /> Apparently the owners were informed by the Realtor that they <br /> were free to vista prune. (The Realtor~ has not returned Ms. <br /> Boretos , telephone call . ) <br /> -2- <br />
