mx-. Sherman asked if materials would be removed according to
the original profile.
Mr.. Force 1 l i responded, "Yes" . He then spoke to references
made by the Assistant Conservation Agent at the time of the on-
site with Argy Corps and C2M, and which had not been addressed at
the Conservation Hearing. Microphetic algae exists along the
coastline and the Assistant Agent expressed concern that it would
become buried. However, the project could not be considered a
beach nourishment as it would remain only temporarily, a few days
at most .
At this point Mr. Sheeran recommended approval on behalf of
the Assistant Conservation Agent and himself .
There being no further Commission or public comment, Mr.
Shaw entertained a motion.
MOTION: Michael Talbot made a Motion to approve the Amended
Order; which Motion was seconded by Carole Moore and so voted
unanimously.
7 : 35 151 Nominee Trust, 400 Nathan Ellis Hwy. , a continuance
from September 6, 2001 .
Mr. Shaw recognized John Sl avinsky, Cape & Islands
Engineering, representing Applicant, who explained the reason for
continuance had been due to the inability to meet the thirty-five
foot setback.
Mr. Slavinsky provided a plan stating Applicant has
replicated a wetland.
Mr. Sherman asked for clarification, stating an order has
already been issued for this parcel of land. (There was some
confusion as to owners/parcel/filings) . He asked Mr. Slavinsky
if he had a copy of the plan originally approved for this parcel,
stating he would like to compare the plans in order to make a
determination as to the parcel under discussion.
Mr. Sherman suggested the matter be held open for two weeks,
as an approval has been grated contingent upon completion of
said work; and to allow time for comparison of the plans.
There being no further Commission or public comment, Mr.
Shaw entertained a motion.
MOTION- Michael Talbot made a Motion to continue discussion
of the subject matter of this Hearing to the October~ 4, 2001
Meeting, at p.m. , at Applicant' s request; which Motion was
seconded by Carole Moore and so noted unanimously.
7 :40 Paul Sugarman, 88 Tide Run, continued from. September 6,
2001. -7-
