Non-Hearing Agenda - old Business <br /> 1 . Request for Administrative Change SE 43-1819 <br /> mr. Sherman explained this is a minor change to a previously <br /> approved brick walkway, no change in footprint, request to raise <br /> walkway by a few inches. He recommended approval . <br /> MOTION: Carole Moore made a Motion to approve request for <br /> Administrative Change SE 43-1819; which lotion was seconded by <br /> John Johansen and so voted unanimously. <br />' <br /> 7 : 30 Leonard Florence, 78 Triton way, continued from <br /> September 6, 2001. A/0 <br /> Mr. Shaw recognized like Force l l i, Holmes & McGrath, <br /> representing Applicant . <br /> 1r. Forcelli explained Applicant is in receipt of an Order <br /> of Conditions to reconstruct rip rap, as well as all necessary <br /> permits to allow the proposed project which is expected t <br /> commence in October. <br /> Mr. Forcelli made reference to the issue of MEPA review, <br /> originally raised by the Assistant Conservation Agent. - He <br /> continued by stating 1EA review is required for a beach <br /> nourishment project. Applicant has undergone the Army Corps <br /> permitting process. on-site inspections have been made by <br /> Army Carps, Coastal zone Management,ent, and the Assistant <br /> Conservation Agent . The Regulations have been reviewed, an <br /> interpretation from MEA has been requested. <br /> Mr. Forcel l i explained the proposal to place materials s on <br /> the beach for the purpose of construction access is not beach <br /> nourishment. The proposed project had originally been described <br /> as beach nourishment. However, a DEP permit is required to <br /> nourish the beach, which necessitates a NEPA review. <br /> In an attempt to avoid said MEPA review, an interpretation <br /> has been obtained from DEP on what was originally identified as <br /> beach nourishment to temporary placement of fill for construction <br /> access . Revised plans to this effect have been filed <br /> simultaneously with the request for Amended Order. <br /> Mr. Sherman asked for clarification that the placement o <br /> fill is temporary in nature and is to be removed upon completion <br /> of the project. <br /> Mr. Porcelli responded, "Yes" . Construction access is to be <br /> created along the base of the wall, as stones are removed in <br /> order to stabilize the fill and work back, the sand also will be <br /> removed. <br /> - - <br />
