The Conservation Commission entered into Executive Session <br /> t 8 : 05 p.m. for discussion of pending litigation - Request for <br /> Externsion. SE 43-980 . A Motion having been duly made and seconded <br /> to do so; an individual Grote having been taken. Executive <br /> Session concluded at : 10 p.m. <br /> Non-Hearing Agendas - old Business - Continued <br /> . Draft/Flexibility Clause - Mr. Sherman provided cope <br /> of Draft Flexibility Clause Ch. 172, , reviewing the <br /> following: How compelling is the need; B To what degree <br /> are normal standards being asked to be put aside -- minor, <br /> moderate, or major; To what degree will compensatory, <br /> mitigating measures required result in significant enhancement. <br /> Evaluations are to be made on a case by case basis, taking <br /> , B, and. C into consideration. <br /> Required Mitigation - Be as close to the resource area <br /> impacted as possible; B) The same wetland value; (C) Demonstrate <br /> by a preponderance of credible evidence the enhancement capacity <br /> of the area; Use of the best available technology, design, <br /> methodologies with possible professional assistance. <br /> References were made to the Table - ( Alteration/Distance <br /> to Resource Area; B) Type of Resource; Area Altered within <br /> section A. <br /> Ir.
