r <br /> Where being no Commission or public comment, the Chairman <br /> entertained a motion. <br /> MOTION: John Johansen made a Motion for a Negative 111 <br /> Determination; which Motion was seconded by Ralph show and so <br /> voted unanimously. <br /> 7 : 25 Myron Kumin, Determination of Applicability on <br /> landscape work at 44 Bayview load, Assessors Map 119 , Block 49 . <br /> The Chairman recognized Dave Consal ire, representing <br /> Applicant . <br /> Elliot Rosenberg stepped dawn on this matter stating he <br /> knows the Applicant . <br /> Mr. .Consalve explained Applicant is requesting permission to <br /> control poison ivy from encroaching into a walkway; and to remove <br /> Autumn olives to be replaced with Bayberry and/or Wildflower Mix <br /> and to prune tree limbs that are hitting the house in <br /> perpetuity) . <br /> r. Sherman stated the wore request is reasonable. He <br /> recommended approval, noting however that perpetuity cannot be <br /> issued under an RDA. <br /> Where being no further Commission or public comment, the <br /> Chairman entertained a motion. <br /> MOTION: John Johansen made a Motion for Legative <br /> Determination; which motion was seconded by Ralph Shaw and so <br /> voted unanimously. <br /> Myron Kumin, for landscape work with maintenance in <br /> perpetuity at 40 Bayview load, Assessors Map 119., Block 48 . <br /> Elliot Rosenberg stepped down from this utter as well, - <br /> stating he knows the Applicant. <br /> Mr. Shenton stated the Dearing in this matter has been <br /> continued at Applicant ' s request, in order to respond to DEP <br /> comments . <br /> There being no Commission or public comment, the Chairman <br /> entertained a motion. <br /> MOTI Ralph show made a Motion to continue the Hearing in <br /> this ratter to November 29, 2001, at 7 : 20 . . , at Applicant' s <br /> request; which .Motion was seconded by Michael Talbot and so voted <br /> unanimously. <br /> 7 .
