There are <br /> a neer of other property owners with a right to the use of said <br /> private road jointly with the Applicant. o notice was given to <br /> those property owners who have an interest to the road. <br /> Reference was made to a letter from Town Counsel with <br /> respect to this matter. "The safest course for a Commission <br /> reviewingn RDA by an Applicant who does not have permission <br /> from all of the lard owners is to deny the application for lack <br /> of information, i.e. a certification of notice to all owners* " <br /> Diane Boretos concurred, recommending .a Positive <br /> Determination, with certified notification to all abutters to the <br /> property, including the roadway. <br /> There being no further Commission or public comment, the <br /> Chairman entertained a motion. <br /> MOTION: Elliot Rosenberg rade a Notion for Positive <br /> Determination; which motion was seconded by Leonard Pinaud and so <br /> voted unanimously. <br /> 7:40 Jason Stole, 3 Harbor Ridge Road, continued from May <br /> o, 2002 . <br /> The Chairman recognized Heathen Wright, Mary LeBlanc <br />
