DEP .has determined there are no other jurisdictional issues <br /> to be Considered. <br /> Diane Boretos Clarified the 10A float is a Chapter 91 permit <br /> (Section 10A under Chapter 91) . <br /> Elliot Rosenberg read, "The scope of the Conservation <br /> Commission' s regulatory authority in the context of the 10A float <br /> issue extends to the regulation of actions which impinge upon <br /> coastal wetland resources. " <br /> Diane Boretos stated the Conservation Commission and the <br /> Harbormaster, under the wells Protection Act and Chapter 91 have <br /> jurisdiction over a float; 10is the issuance from the <br /> Harbormaster of a permit; a Conmission can Choose whether or not _ <br /> o review the issue. <br /> i <br /> Diane Boretos recommended approval, as concerns regarding <br /> cutting have been resolved by relocating the pathway. <br /> C nnissioner John Johansen excused himself from the Meeting <br /> at this point, p.m. ) <br /> There being no further Commission or public comment, the <br /> Chairman entertained a motion. <br /> MOTION: Ralph Shaw rade a Motion to Close; which Motion was <br /> seconded by Elliot Rosenberg and so voted unanimously <br /> James Co fair, 5 Monomoscoy Road West, Revocation of <br /> Permit. <br /> Diane Boretos reported Applicant has requested a <br /> continuance. <br /> MOTION-- Ralph Shaw made a Motion to continue the Hearing in <br /> this ratter to July 25, 2002 at 7 : 00 p.m. ; which Motion was <br /> seconded by Elliot Rosenberg and so voted unanimously. <br /> 8 <br /> : 05 Robert �o turn, after the fact, l roof and <br /> move a greenhouse at 12 Quinapen Road, Assessors Map 72, Bloch 2 . <br /> The Chairman determined there was no one present at the <br /> Meeting to represent the Applicant. <br /> Diane Boretos reported on her inspection of the site as a <br /> result of aux Enforcement order.
