4 <br /> Ms. Fantoz i reported Applicant has requested a continuance. <br /> oTI _Oil: i hae l Talbot made a Motion to continue the <br /> Dearing in this matter to July 25, 2002 at 7-645 p.m. , at <br /> Applicant ' s request; which motion was seconded by Ralph Shaw and <br /> so voted unanimously. <br /> 7 : 15 Shoestring Bay LLC, 5 and 3 Mute swan Circle - vista <br /> i Pruning, Assessors Map 84, Blocks 37 and 19 . <br /> The vice Chairman recognized Wayne Tavares, representing <br /> Applicant, and informed hien of a Memo from the Assistant <br /> Conservation Agent stating a number of missing items. Stamped <br /> surrey plan for Lot ; revised landscape plan showing improved <br /> resource areas and limiting vista pruning corridor to Lot ; <br /> proposed work on Lot 5 fall within Conservation jurisdiction; and <br /> amended request for Lot 5 to be filed; as well as providing <br /> authorization from the landowner for proposed work to be done. <br /> r. Tavares noted surveyor reference made to the bottom of <br /> the plan. Authority has been given for the use of the plan. He <br /> did agree to provide a stamped plan if requested by the <br /> Cormnission. Applicant has agreed to remove 5 Mute Swan circle, <br /> amending the Lot/view corridor. An easement from willowben.d <br /> the owner has been included within the Notice of Intent, <br /> which grants certain rights and easements. <br /> Ms. Fantorti indicated there is some confusion with said <br /> easement, referring specifically to Lot 26. The "open space" <br /> area should be clarified/defined. <br /> Michael Talbot made reference to the Assistant Agent' s notes <br /> regarding tree removal - Town of Mashpee guidelines. <br /> The Clerk request Attestation of ownership be provided; and <br /> requested Mr. Tavares to submit paperwork NOI in proper <br /> sequence, as required by the Commission. <br /> r. Tavares continued, explaining the path of least <br /> resistance had been chosen for the view Corridor. It is <br /> necessary to remove some of the trees in order to create a vista. <br /> Said trees are less than -inches caliper, and less than o <br /> total number of trees. All trees being removed or pruned have <br /> been tagged. <br /> The vice Chairman recognized mark De iasse, Bartlett Tree. <br /> Michael Talbot clarified the intent of theBy-law. <br /> M'. Tavares requested a site-visit with a representative <br /> from the Tow . He also expressed a desire for mitigation in <br /> another area. <br /> -3- <br />
