that remediation is necessary recommendations are to be made at
that time; which Motion was seconded by Ralph Shaw and so voted
unanimously.
8 : oo Janet C. Procek, 12 Great River Road, demolish is house
and construct a new one, decd., walkway, septic, and utility
service.
The vice Chairman recognized Dave sanicki, Cape & Islands
Engineering, representing Applicant.
Ms . Fantozzi reported no nitrogen calculations had been
provided with this request. Applicant was under tho mistaken
impression that due to' the fact a three bedroom house .is being
demolished and replaced by another three bedroom house, this
information is not necessary. TheBy-law states said
calculations are required for redevelopment, different footprint
and associated structures. work is being proposed (demo and
rebuild) within the fifty foot buffer, whereby nitrate loading
information is essential as theBy-law prohibits any work within
said. buffer. Also, architectural plans and a DEF Neer is
required with this f it ing.
(There was some discussion regarding nitrogen credit, fast
systems in a general generic sense, and the permitting process
for such 1provisional and general used . Fast systems are not
permitted in the Commonwealth of Massachusetts for general
nitrogen removal. )
Mr. Sanicki informed the Commission that he had been asked
to provide the above information two (2) days ago. He agreed t
address all issues raised.
Mr. sanic} i reported the Board of Health has reviewed and
approved the proposed plan on June 27, 2002 . There are testing
requirements upon issuance of the permit which will require
operating maintenance. The denitrification system is currently
on-site for the existing dwelling. It will be reused and
relocated in a different position.
Mr. sanic i then prodded an overlay from the original, plan
showing the two houses. Nitrogen loading calculations for the
proposed denitrification indicate ars eighty 0 percent
nitrogen reduction, 5. 06 parts per million. There is not, nor
ever has been a natural buffer strip on the site. The existing
house has a full basement; the newly proposed construction will
be built under FEMA regulations nothing below grade) , with a
non-habitable crawl space. The deck is considered to be a
required egress by the Building Department .
It was determined the fast system approved by the Board of
Health -s considered to be remedial .
