CONSERVATION COMMISSION Minutes of 08 August, 2002 Public Hearing as pee Town Hall Meeting Room 3 Commissioners Present: John Johansen, Leonard Pinaud, Elliot Rosenberg, Michael Talbot Staff Present: Diane Boretos, Assistant Agent, Peggy Fantozzi# Temporary Agent Elliot Rosenberg, Vice Chairman, called the meeting to order at 6:55 p.m. Public Comment: None- Non-Hearing Agenda Re: Sub-division roadway issues. Elliot Rosenberg recommended adopting a policy whereby anytime there is.a question involving an unapproved roadway in a private subdivision, a requirement of that application is to provide the original subdivision plea and any covenants attached to it, so we vAII know what the circumstances are. This can be taken rare of in a policy meeting. This falls under Conservation Commission for this reason. We've had two cases in the last 4-5 weeks, one involving a fence in a so-called paved street. The legal issue with respect to that is: Is it a street? Do the rest of the residents have any rights in that street? The only way to-determine that is to go back to the original subdivision plan as approved by the Planning Board and the Board of Appeals and recorded in the Registry of Deeds. Other: Peggy Fantozzi announced the good news that Bob will return to his job on Monday. Commissioners praised Peggy's work. Motion.made; seconded; and unanimously carried for the Commission to write letter to Peggy expressing their appreciation for her work. Re: Enforcement order. Diane Poretos asked for ratification of an enforcement order at 36 Sum ersea Way. About two gears ago there was clear cutting done at this site and last geek she happened to be driving by and heard the buzz saws, knocked on the door and spoke to the owner, and found the crew removing slash from what was left of second and third cutting.
