wells should be put in as soon as possible after the gutters are put in, and the applicant
must submit a more finite plan a plan view and a cross section view) which will show
homer the area will be stabilized.
Motion made, seconded and unanimously carried to approve a continuance to
November 7 at 7:35 p.m. at the request of the applicant.
7:40 p.m., shoestring Bay Fealty Trust, 3 shoestring Bay Road (continued from
10/3). Michael Gr tsky represented the applicant. The request was to move a
previously approved footprint considerably closer to the coastal bank. He feels it would
not be inappropriate or inconsistent with what was approved in the adjacent lets. Jack
asked if the conceptual original footprints on the neighboring lots are set in stone or
can we change them. Bob said if they have a valid Order of conditions and it hasn't
expired yet, vire can't noir go back and change it. But if they say they grant to change it
and move closer, they face the same situation as Michael does now. Bob will look u
the records and ascertain the status of the permits --when they g ill expire and if they
are still legally valid.
Motion made, seconded and unanimously carved to approve a continuance to
November 7 at 7:40 p.m. at the request of the applicant.
7:45 p.m., Irwin is S aw, 5 sunset circle (construct horse, porch, deck, garage,
plantings, driveway, utilities, Title V septic). John slavinsky, cape & Islands
Engineering, represented the applicant. The main issue was the request to put a 40 ft.
house on a 75 ft. lot. Elliot suggested that he go to the Board of Appeals to get a
waiver on the 15 ft. side line.
Motion made, seconded and unanimously carried to approve a continuance to
November 21 at 7:05 p.m. at the request of the applicant.
7:50 p. ., Louis Ohne , Jr., 75 Pop ponesset Island Road (reconstruct house,
driveway, utilities, and rebuild retaining wall). John slavins y, cape & Islands
Engineering, represented the applicant. A sassafras tree presented a problem
because it is in the riddle of the proposed driveway. Diane suggested roving it and
Michael said moving a sassafras is very difficult because they have very shallow roots
and a big root spread. Diane suggested that the Commission approve a letter from the
landscaper as to hoer he will move it. John slavinsy said they will not proceed with
the project if the tree can't be transplanted.
Motion crude, seconded and unanimously carried to approve the plan contingent on
receipt of a letter from the landscaper describing his proposed procedure for moving
the sassafras tree and the commission's approval of the proposed procedure.
