Bob said when the engineer did the latest version of the plan, he did not show the <br /> coastal bank. Bob recommended mended approval subject to confirmation from the Board of <br /> Health that application has been filed if one is needed , and the applicant will write on <br /> the plan that the coastal plan is defined by the previous referenced plan. <br /> Motion made, seconded and unanimously carried for a negative determination subject <br /> to the Board of Health approval and the applicant writing on the plan that the coastal <br /> plan is defined by the previous referenced pian. <br /> 7:50 p.m., Arlene Byrne,) 99 Monor oscoy Road West {continued from 11/17/02). Bob <br /> said the wetland line is in question, and he recommended a continuance. <br /> Motion made seconded and unanimously carried to Grant a continuance to December <br /> 19 at : o p. ., at the request of the applicant. <br /> 7:55 p.m. Mashpee Water District, Old Barnstable Road water main/appurtenances). <br /> Lynn Hal n and David Rich represented the applicant and presented the plan. Mr. <br /> Rich assured the Commission that laying the pipe under the Childh Kiger v ill have no <br /> impact on the rimer. They have previously laid a water pipe measuring about 900 ft. <br /> and -had no problem. <br /> Motion rade, seconded and unanimously carried to approve the project. <br /> :00 ,m,, Bayswater Developmentg LLC, Fairway Lane and Seanest Drive <br /> (continued from 1117/02). John Vaccaro, Earthtech, represented the applicant. Bob <br /> said we can't approve this project tonight because 1 Dune had submitted with Bob's <br /> approval a request to Town Counsel for some legal interpretations, and 2 Diane <br /> indicated that she was not yet in agreement with all the issues. <br /> Mr. Vaccaro said in the previous meeting Diane had requested some changes to the <br /> plan, which were made in time for this meeting. He learned yesterday that there were <br /> some additional issues, and 1 he requested the nature of the request that has been <br /> made to Town Counsel, so his client can provide that information (Bob said he can <br /> provide him with that), and 2 he asked that Bob or Diane try to view the flags before <br /> the next meeting. (Bob said he'll do his very best.) <br /> Motion made, seconded and unanimously carried to grant a continuance to December <br /> at :30 p.m., at the request of the applicant. <br /> 8:05 p.m., shoestring Bay Fealty Trust, 23 Shoestring Bay Road d (continued from <br /> 11/7/02). Mike trot ke and Mike Ball, Horsley and Witten, represented the applicant. <br /> Mr. Grot ke said one the questions asked at the last meeting was whether the Order of <br /> Conditions was still valid. He checked the records and they were extended last year <br /> and approved by the Commission, and are valid to September Zoo . <br /> 6 <br />
