• Michael Talbot rejoined the meeting. <br /> 7:10 p.m., John Belland, 44 Barbary Circle (rebuild/modify pier). Jack Vaccaro <br /> represented the applicant and presented the plan. Because a portion of the <br /> construction begins over the salt marsh, that portion must be revegetated with <br /> bayberry. <br /> Motion made, seconded and unanimously carried to approve the plan with the <br /> stipulation that there be an open grading installed for the surfacing of the extension <br /> over the salt marsh and revegetation with bayberry in the salt marsh area. <br /> 7:15 p.m., Edmond English, 3 Ocean Bluff (continued from 2/27/03). Michael Grotzke <br /> and Sarah A. Turano-Flores, Zisson and Veara, represented the applicant. <br /> Bob distributed to the members a letter from Joan Quilty, an abutter. <br /> Bob stated that LEC Environmental Consultants (LEC) has been retained by the <br /> Commission to give us a second opinion on the case and Don Shawl's <br /> recommendations. Bob said he met with Paul Lelito and his assistant from LAC last <br /> Tuesday and they described their analysis. However, Mr. Lelito wants to discuss some <br /> additional things with Bob before he writes his report, and he and Bob have been <br /> playing telephone tag, so Bob does not have the report in hand. <br /> Bob reported that he also met with Jim O'Connell, CZM geologist, and Stan Humphries, <br /> coastal geologist, and they discussed the terminology that was used to determine the <br /> dune/bank interface. There were some differences in the interpretation, but even after <br /> they discussed the various approaches, it didn't change the point at which the <br /> dune/bank interface was demarked. So Bob doesn't have any disagreement with the <br /> dune/bank interface and the vegetated wetland lines. <br /> Motion made, seconded and unanimously carried to grant an extension to March 27th <br /> at 7:30 p.m. at the request of the applicant. <br /> 7:15 p.m., Anthony P. Gargiulo, 11 Ocean Bluff Drive (continued from 2/6/03). Mr. <br /> Garguilo was present. Representing him were Michael Grotzke and Sarah A. Turano- <br /> Flores, Zisson and Veara. Representing Wilson D,. Rogers, Jr., an abutter, was <br /> Michael J. Fazio, Jr., The Rogers Law Firm, and Paul Davis, PHD. <br /> Mr. Fazio had given Bob just before the hearing some testimony on behalf of Mr. <br /> Rogers. Since Bob has had no chance to digest it, he said he couldn't recommend a <br /> closing at this hearing, so there will have to be a continuance. Bob recommended that <br /> Mr. Fazio give his written presentation to the members and the applicant, and it will be <br /> • available in the Commission's office for all interested parties to review prior to the next <br /> hearing. <br />
