Stephanie said it is her understanding that an RDA cannot be conditioned. Bob said <br /> we can condition it by having a note added to the plan itself that a subsequent filing will <br /> be done to address these issues by a certain time period. <br /> Mrs. Hunt, a neighbor, registered concern about the water run-off impacting vegetation <br /> on their property. Jack asked if there is any possibility that if Mr. Lowe installs this wall, <br /> there may be subsequent recommendations that it be installed differently? Bob said it <br /> gets to the point of whether or not this Commission wants to require an engineered wall <br /> when the Building Inspector doesn't see a need for it, and since whatever happens <br /> here is a civil problem, it's the Building Inspector who has jurisdiction over it. He said <br /> he doesn't want to diminish the Hunt's problem, but even if this wall failed, it would not <br /> affect the resource area, and he doesn't see a need to have an engineered plan at this <br /> point. He thinks the need is to have a lot more thought as to what we do for run-off <br /> aspects other than the wall. <br /> Marshall Brem, 21 Harbor Ridge Drive, said what was agreed to at a former hearing on <br /> this matter didn't happen. He said there was supposed to be a 22 ft. arm to demolish <br /> the house and what couldn't be reached was going to be done by hand. Jack said he'd <br /> like to confine the discussion tonight to the application on the table, not history. Mr. <br /> Brem said how are they to know that what is said in this meeting is what will be done on <br /> the site. Jack said that during the course of the job or after it is complete, our staff will <br /> check the site, and if something is being done or has been done incorrectly, we will get <br /> a cease and desist order --we do that all the time, it's not uncommon. <br /> Motion made, seconded and unanimously carried to approve the wall, conditioned by <br /> Mr. Lowe and the Conservation Agent adding additional language on the plan requiring <br /> additional applications for run-off issues above the wall and the driveway surface, and <br /> have it submitted within a month. In addition, we won't issue it until the note has been <br /> co-signed by Mr. Lowe and the Conservation Agent. <br /> 7:30 p.m., David Cole, 77 Meadowbrook Road (remove and replace breezeway and <br /> garage). Joe Harvey represented the applicant and presented the plan. Bob <br /> recommended approval pending his checking the records to make sure that it is a <br /> three-bedroom house. Michael pointed out that the 50 ft. setback applies to the work <br /> limit, not the house, and any incursion into that area requires mitigation plans. He said <br /> it would not be a lot of mitigation plantings in this case because it's a pretty minor <br /> incursion. Bob will meet with Mr. Harvey at the site to decide on the plantings. <br /> Motion made, seconded and unanimously carried to approve the plan pending <br /> confirmation that the house has three bedrooms and an agreement on mitigation <br /> plantings. <br /> 7:40 p.m., Edmond English, 3 Ocean Bluff(continued from 5/22/03).
