. 7:15 p.m., Amanda and Christopher Burden, 135 Daniels Island Road (install <br /> additional floats to existing pier). Cass Costa stepped down for this hearing. <br /> Michael Grotzke represented the applicant and presented the plan. Bob recommended <br /> approval pending a conference with the Harbormaster, the Shellfish Warden, Michael <br /> Grotzke and himself to find appropriate conditions for how boats will be deployed at the <br /> float. <br /> Motion made, seconded and unanimously carried to approve the plan subject to the <br /> decision made at the above conference regarding the appropriate conditions for how <br /> boats will be deployed at the float. <br /> 7:20 p.m., Save Popponesset Bay, Popponesset Creek and Spit (continued from <br /> 5/22/03). Kevin Harrington, Chairman of the Board of Save Popponesset Bay, <br /> represented the applicant. <br /> Jack reported that we received a letter today from our Town Counsel which had been <br /> requested at the last meeting. Since this letter has not met the requirement to be in our <br /> files for five days prior to this meeting, the applicant has the right to regroup and decide <br /> what they want to do. Jack said that the letter is couched in such terms that even <br /> those on the Commission who support their Notice of intent to dredge Popponesset <br /> Beach would not be able to vote in favor of it. <br /> • Mr. Harrington distributed to the members a report which gives their response to the <br /> hearings and requested a continuance. <br /> Jack asked Bob if he felt it worthwhile for us to review our understanding of the <br /> performance standards that apply here. Bob said he thinks it is our duty to take two <br /> more weeks and not render any decisions tonight. <br /> Mike Oleksak asked about an amendment of the Notice of Intent. Bob said the <br /> applicant can always amend the narratives and the information in the NOI provided the <br /> DEP gets a copy and we have it at least five days prior to the hearing. <br /> Motion made, seconded and unanimously carried to grant a continuance to June 19th <br /> at 7:25 p.m. at the request of the applicant. <br /> 7:25 p.m., Russell Lowe, 11 Harbor Ridge Drive (continued from 5/22/03). Mr. Lowe <br /> presented the plan. There was considerable discussion regarding the run-off of water <br /> on a bank into a neighbor's property. Bob suggested that Mr. Lowe consult with Don <br /> Liptack to get his recommendations for integration into the plan. Bob said the water <br /> run-off issue does not impact the resource area and therefore is not under our <br /> jurisdiction, and he recommended approval with the condition as part of the RDA that a <br /> subsequent plan will be filed to consider run-off aspects of areas above the wall and <br /> areas to the south and the surfacing of the driveway for approval. <br /> A <br />
