Bob said he doesn't think the amended order should be denied. Mr. and Mrs. Avitabile and their son were present. Bob said he has <br /> been working with Mr. Avitabile and his son with a plan that would meet our standards. <br /> Bob did some nitrogen calculations and other work. He was to meet him today to go <br /> over the plan with the idea that they would work further on it and have a plan which <br /> could be acceptable. When he went out there, he found a large area of vegetation cut, <br /> which he had told them in an earlier meeting not to cut, an illegal deck, an illegal <br /> driveway, the loam for the lawn had already started to be replaced around the property <br /> without a permit, and he recommended we deny the permit and issue an enforcement <br /> order. <br /> Mrs. Avitabile said they have worked with Mr. Sherman for the past 2 112 years on their <br /> plan for the property they've owned for 30 years. In November 1999 they received a <br /> note that they are in Zone 2 requiring a septic V system, they went to the Barnstable <br /> Registry of Deeds and were told they were not in Zone 2. Then they learned that their <br /> property had a very small piece of wetlands on it. They hired Mr. Ball, Horsley & <br /> Witten, who said according to State regulations their property is not wetlands, but <br /> according to Mashpee it was. Their property was reduced to half the size, and the <br /> zoning was changed requiring them to install a denitrification septic system which sits <br /> in front of their front stairs, and now they hear it's not necessary.
