It shows three rocks, but he sees from the <br /> photo that there are six rocks, so it should be corrected to show that. He doesn't agree <br /> that we need to show the other adjacent resources because they're shown on another <br /> plan on file with us which was withdrawn because he didn't supply us with information <br /> about the erosion rate of the bank. He said whether there are six or eight rocks, it <br /> would still meet our performance standards. <br /> Michael said all this is predicated on the assertion that these delineations are correct, <br /> and he'd like to see that they are. <br /> A woman said they are talking about sand that has been dumped on Mr. Blythe's <br /> property that spilled onto the spit, which is public property. <br /> Elliot said there are two issues here. 1) whether or not anything done here violates the <br /> regulations and 2) the access issue, and we are not able to make any decision based <br /> on access to this property. <br /> Jack recommended we request a plan that shows an accurate delineation of the <br /> resource area and investigate if there have been any alterations which have not been <br /> included in their Notice of Intent. <br /> Bob said we can certainly get a more accurate plan in terms of the number of rocks, but <br /> in terms of topographical changes, we don't have a "before" plan, so he doesn't know <br /> how we can tell if it's been changed. <br /> Barbara O'Neil, 14 Strawberry Lane, submitted a "before" picture that shows the road <br /> with three rocks and an "after" photo showing more rocks with sand. <br /> A resident asked about Autobahn concerns. Jack said the pipers will not be disturbed <br /> as they are at the other end of the spit owned by Save Popponesset Bay Association. <br /> Bob said it's not a rare species area, so we can't get involved in that. <br /> Mr. Blythe said last spring two different companies were clam shelling at the end of the <br /> spit and rebuilding the stone wall. When they left they deposited the sand and told him <br /> that one of their Order of Conditions was to replace it to its natural state. They put the <br /> sand from the waterline back to the lots. <br /> Michael said the problem is that since it is his property, those alterations still come <br /> under his consideration. Mr. Blythe said that may be true, but the person who had the <br /> Order of Conditions asked him to move the rocks, so the responsibility also falls on the <br /> • shoulders of that person with the Order of Conditions to make sure it was done <br />
