2002, and they are now requesting a maintenance in perpetuity permit. Bob said the <br /> work falls within the confines of our prescribed crista pruning parameters. He <br /> recommended approval with the request that one area of slash be dispersed or <br /> removed. <br /> Leonard Po net, 17 Groat Oak Road, said that this site has been recognized for <br /> centuries as a very sacred areaby the Il ashpee Wompanaug people because it's <br /> where the fresh water meets the salt water. This spring he and his wife visited the site <br /> and were surprised that a bench had been installed over a concrete base and pruning <br /> had been done. He doesn't understand why the saplings have been cut down. The <br /> vista has been there for thousands of years without any pruning. <br /> Bob said the Trustees of Reservations do good work, but none of this work was <br /> permitted — not the pruning, the bench or the cement base. However, if they had filed a <br /> Notice of Intent, we would have to permit all of this work under the law. <br /> Mr. Poc net said the sacredness of the area goes beyond the usual parameters, and he <br /> would like to see the bench removed and a small plaque to remind everyone visiting the <br /> site of the sacredness of the area, that it's not just an ordinary path. <br /> Bob said we can't mandate that, but Messrs. Walsh and Freeborn said they would be <br /> happy to.meet with Mr. Poclrret to discuss some sort of signage at the site. <br /> Mrs. Poc net said her ancestors have recognized the sacredness of this area for <br /> thousands of gears. There's no reason for people now to have to sit there. Her people <br /> want to maintain it as it has been. She doesn't see any added value in the bench or the <br /> pruning} and she appealed to the Commission to listen to their concerns and not just <br /> routinely follow the law. <br /> Bob recommended approval of the X101 because it follows our prescription for vista <br /> pruning with the condition that they will have to file an Amended order to show the <br /> bench on the plan, and they will have to renotify abutters. He repeated that the bench <br /> would be permitable under the standards of the by-law, but the Trustees of <br /> Reservations may want to take into consideration the feelings expressed by Mr. and <br /> Mrs. Pocnet that go beyond the law. If they remove the bench, they will not have to <br /> apply with an Amended order, and we would issue an Order of Conditions to permit <br /> vista pruning with maintenance in perpetuity. <br /> Cass added that we recognize that this area has such intrinsic value as expressed b <br /> Mr. and Mrs. Pocknet, and we have great respect for this land and their concerns. <br /> Motion was made, seconded and unanimously carried to approve the plan with the <br /> condition that they will have to file for an Amended Order to include the bench, and with <br /> the condition that Messrs, Walsh and Freeborn meet with the Conservation Agent at the <br /> site to decide on whether the pile of slash should be removed or dispersed. <br />
