Page 3. <br /> COUNSEL: and they wanted to know the names of the other Board of Health <br /> members , so that they could contact them. I told him that <br /> it was Mr. Wilson and Mr. Buckingham. It was then made known <br /> to me that the party that was having the problem with the <br /> sewerage was a secretary in their office. It has some sub- <br /> stantial bearing on what took place thereafter. Mr. Farrell <br /> and Mr. Duffy too were quite irate at the fact that they <br /> couldn 't seem to get any satisfactory answer as to where their <br /> client could deposit the sewerage that had accumilated in her <br /> system and it was causing it to back up into her basement. <br /> They had called the Board of Health and been informed, I am <br /> advised, that there was nothing that could be done . Now, <br /> this is what they told me , okay, I received a call about <br /> quarter to five, I guess it must of been, maybe five o 'clock <br /> or so, from Mr. Farrell informing me that he hadn' t been able <br /> to secure any satisfactory answer from anybody, and he was <br /> going to commence an action in Superior Court, he was going <br /> to be looking for some form of injunctive relief in the morn- <br /> ing. So, the following morning I contacted Executive Secre- <br /> tary and informed him as to what was going on and asked him <br /> to contact Mrs. Anderson. I had tried to contact the Board <br /> of Health, but I couldn' t get through, the line was busy . <br /> So Joe got hold of Nonnie, because Nonnie came down to court <br /> and met me down there in the Clerk 's office." <br /> 4OTHOMAS: "Now is this yesterday?" <br /> N COUNSEL: "This was yesterday . Judge Dolan issued a temporary re- <br /> straining order, restraining the Board of Health from re- <br /> fusing to accept septage from inhabitants of the Town of <br /> Mashpee for the disposal at the landfill. Essentially, <br /> what she said was that the Board of Health is injoined <br /> from making arrangements , it placed the powers , it was <br /> turned in negative, it was cast in negative terms , but <br /> it cast a positive obligation on the Board of Health to <br /> either receive the septage of the residents of Mashpee in <br /> the septage lagoons there, or make other arrangements . That <br /> temporary restraining order was made returnable by the <br /> Judge on December 2, which I believe is on a Tuesday. " <br /> BOARD: "Thursday, December 2 . " <br /> TOWN COUNSEL: "Returnable at 10 :00 o' clock. There will be a hearing at <br /> 10 : 00 o' clock to determine whether or not that temporary <br /> restraining order should become a preliminary injunction. <br /> Well as soon as the court took the steps to do this , I than <br /> decided I better find out what our position was as the Town <br /> matter. I contacted Nonnie again, I met with Nonnie, as I <br /> said, down at the court house and 'she had informed me, that <br /> she thought that they could- put the lagoons into a partial <br /> operating condition so that they could receive at least a <br /> load. That is just what she said, a load. Meaning to take <br /> care of this woman' s problem by Monday. She thought this <br /> was a possibility. So, she indicated to me what had happen- <br /> ed that is that the project had been delayed because in the <br /> course of excavating the sludge for the purpose of renovating <br /> I <br />
