THOMAS : "Well let' s go on to these wonderful waivers , please_ If you <br /> will examine them please, exibit A, and exibit B." <br /> TOWN COUNSEL: Well I have taken a look at these and it seems to me :that <br /> there is a contradiction in the first paragraph. `' I don' t. <br /> know how to draw a dichotomy between administrative res- . <br /> ponsibility and regulatory control . I am very puzzled by <br /> that because regulatory controls , to my way of thinking, . . <br /> anyhow, is administrative responsibility. I certainly, <br /> would not want to be given a job and told you administer <br /> this job but you can' t regulate it, that's not making any , <br /> sense to me . I don' t understand that . Maybe this can be <br /> clarified by the Board of Health, but just looking at it <br /> without speaking to them I can' t understand what they are <br /> driving at here . If administrative responsibility means <br /> setting hours , setting terms under which the dump can be <br /> used, whether pumpers will have a key or not, that sort <br /> of thing, than by administrative responsibility fine I have <br /> no difficulty with that, but that I am afraid that term <br /> regulatory control, means setting hours of computation, <br /> setting the fees, setting who will have keys , etc. If that is <br /> what that means , I an puzzled by what this suggests here . <br /> SEL. GARLAND: "At the moment Joe , and only at the moment, my feeling is we <br /> are either going to fish or cut bait. They will take the <br /> whole ball of wax or we will take the whole bottle of wax. <br /> I don't want personally, and this is nothing we 've discussed <br /> so I am speaking only singularly on this subject, I don't <br /> want divided responsibility. That is creating the problem <br /> now. <br /> TOWN COUNSEL: "That is what this suggests now. It is divided responsibility <br /> over a subject matter that could easily be determined as <br /> being administrative as well as regulatory so you are going <br /> to have problems . " <br /> SEL. GARLAND: "The problems partially exist right now because of this divi- <br /> sion. " <br /> CHM. THOMAS : "Joseph,would you mind calling the Board of Health and seeing <br /> if they wouldn' t mind coming up here to meet with us and to <br /> discuss this waiver. My feeling Joe , is that there is a <br /> responsibility here whether it is the Selectmen or the Board <br /> of Health, and when a person'.is in trouble you have got to <br /> find an answer for them, Board of Health, Public Safety, that <br /> is what we are here for. " <br /> TOWN COUNSEL: I would sugges that it would be appropriate before you ad- <br /> journ today to go into an executive session in order that <br /> I might report. to the Board and to the Board of Health in a <br /> joint session, perhaps , some results of my investigation <br /> that I conducted today. Which I feel are prejudicial to <br /> our posture in this suit. Very much so if the details that <br /> I have uncovered are revealed publicly at this time. " <br /> CHM. THOMAS: "Can we properly go into executive session Joseph?" <br />
