Owner of Record- Jeanne E. Adams <br /> Revocable Trust of T ati l eta MA. <br /> Sitting: Robert Nelson, Richard.Guerrera and Marshall Brenn <br /> Michael 'Cin represents the petitioner in this hearing. They are seeping a Variance in <br /> order to have a lot in a landlocked ed subdivision become buildable. He proposes t <br /> combine 4 lots, which are inadequate with respect to frontage requirements and land <br /> space requirements under the current.zoning. Ire the R-5 zoning district, it requires <br /> 80,000 square feet per lot and 150 feet of frontage. The end result of his proposal would <br /> contain a lot with 52,400 square feet and 108.24 feet of frontage. All taxes were assessed <br /> as individual lots and paid as such. with this property sitting in Zone 11, the Board of <br /> Health requires at least 10,000 square feet Of land per one bedroom.om. Certainly, three lots <br /> containing hones that only have one bedroom is not what was meant for this subdivision <br /> and would not be reasonable for the area. petitioner reeds ZBA approval to move <br /> forward with the sale ofthe lots to combine them into one lot. This can be clone by deed <br /> transfer. The Board checks with Building Inspector muss wheeler and he feels the <br /> proposal is reasonable so long as the -foot front setback requirements and 25-foot <br /> sideyard setback requirements are met. The Board questions the petitioner as to some <br /> specifics of the location of the lots and where the house would be built. After some <br /> discussion back and forth, Mr. Brem moves to grant the necessary variances to deem this <br /> proposal a buildable situation. Mr. Nelson seconds the motion. All agree. S0 moved. <br /> The variances are as follows: <br /> - a 41.76 foot frontage variance <br /> a 27,600 square foot lot size variance. <br /> This is subject to DEP approval through the Board of Health and is condition upon plans <br /> from A&M Band Services of So. Youth elated July 24, 2003. V-03-107 <br /> John and Mary Ryan: request a variance from Section 174-31 of the ZoningBy-laws <br /> in order to vary the front yard setback requirements to replace the existing 2 ' x 3 ' <br /> dwelling with a 2' x 33' dwelling on property located in an -3 zoning district at 13 <br /> Overlook Knoll Road Map 118 Parcel 27 l ashpee, MA. <br /> AND <br /> John and Mary Elam Request a Special permit under Section 174-20 of the zoning <br /> By-laws in order to demolish the existing 26' x 34' dwelling and replace it with a .' <br /> 3' dwelling on property located in an r-3 zoning district at 13 Overlook Knoll Road <br /> (Map 118 Parcel 3 lashpee, MA. <br /> Sitting: Zlla Elizenberry, Robert Felson and Richard Guerrera <br />
