F <br /> Mashpee Zoning <br /> Board of Appeals Minutes <br /> September 10, 2003 <br /> with the wholesale landscape business. The business will be compatible with others in <br /> the area and will not adversely impact the community nor will it be more detrimental t <br /> the area. The Design review Co=ittee has approved the building. <br /> IVIS. Elizenberry questions the applicant regarding any oil changes and disposal of <br /> hazardous waste material. Mr. Maffei informs the Board that he works s with a hazardous <br /> waste hauler who documents all such materials and its removal and would be happy to <br /> supply the Board with said documentation. Mr.Nelson asps the applicant what types of <br /> materials the building will be built with. Mfr. Maffei tells him veneers and brick and <br /> refers to morgan buildings. The Board discusses signage issues and the applicant says h <br /> will be back when that portion of the project is completed. Mr. wheeler would lite to <br /> have the Design review Committee's recommendations and approvals written into the <br /> decision. Mr. wheeler offers to work with applicant on the bond issues since this is a <br /> landscaping business. The Board agrees to defer the bond requirement to Mr. wheeler. <br /> There are no comments from the audience. Mr. Nelson moves to grant the Special Permit <br /> r <br /> to applicant. Zella Elizenberry seconds the motion. All agree. So moved. reference <br /> submitted plans and Design Review sew Corrmmittee approval. <br /> Armine Sabatini. requests a Special Permit from Section 174-25(A)(8) of,the Zoning <br /> By-laws in order to build an accessory structure in-law apartment) property located in <br /> an R-5 zoning district at 6 Kelly road (Map 78 Parcel Mashpe , MA. <br /> Sitting: Marshall Brenn, Zella Elizenberry and Richard Guerrera. <br /> Richard and Arrnine Sabatini represent themselves at this continued hearing. Mr. <br /> Sabatini was before the Board on June 25, 2003 seeking a Special Permit for a.n accessory <br /> structure. .The Board-felt the drawings presented at that time were not sufficient to render <br /> decision. They asked Mr. Sabatini to have new drawings rendered and cone back to <br /> the Board. Mr. Sabatini presented the new drawings to the Board and the Board felt <br /> satisfied with this plan. FIs. Elizenberry asked Mr. Sabatini if it will be owner occupied <br /> and he said that it would be. Mr. Brem moved to grant the Special Permit. FIs. <br /> !Elizenberry seconded the notion. All agree. So moved. <br /> Johnelb r ink Request a variance from Section 174-31 of the ZoningBy-laws in <br /> order to vary the front setback requirements, lot size and relief from contiguous lot <br /> ownership to build a house on property located in an R-5 zoning district at 25 Pondview <br /> Avenue (Map 58 Parcel 77)Mashp e, MA. <br /> Sitting: Robert Felson, Zella Elizenberry and Richard ruer~r ra. <br /> Attorney Mathew Dupuy who works with Attorney Tracy Taylor (who last represented <br /> Mr. Pellegrini) is speaking for then tonight. This matter was continued from August 13, <br /> 2003 in order to have Mr. Pellegrini's tax records evaluated. Mr. Brem again addresses <br /> the issue of why the land is only valued at $4,800 when all the surrounding lots are <br />
