zf� TOWN OF MASHPEE Zoning Board of Appeals Minutes - Wednesday, January 22, 2003 The Mashpee Zoning Board ofAppeals held Public Hearings on Wednesday, .fi r 22, 2003 at 7:00 P.M. at the Mashpee Town lull. Board Members Jaynes Regan and Robert G. Nelson were in attendance along with Associate Members Z lla Elizenberry, Richard Gu rrera and Frederick Borgeson. Mashpee pee Building Inspector Russell Wheeler also attended the meeting. Vice Chairman James Regan brought the meeting to order at 7:05 p.m. Associate Member Fred Borgeson' reads a letter of resignation to the Board for the record. Fetter is attached to the minutes. The Board regretfully motions to accept Mr. urges n's resignation. Motion is seconded. So moved. Fetter to be delivered to all concerned parties. Edmond Clermont: bequest a Special Permit under Section 174-2 of the Zoning By- laws in order to demolish an existing house and build a new house on property located in ars R-5 zoning district at One Sunset Circle Map 64 Parcel 3 Mashpee, IIIA. Owner of Record: Marjorie Hegarty, Paul J. Hegarty, Thomas P. Hegarty, John F. Hegarty, and Mark S. Hegarty of Weymouth, MA. All Edmond Clermont: Request a variance from Sections 174-33, 174-31 and 174-21 ofthe ZoningBy-laws to vary the distance to the wetlands, increase lot coverage, vary the side setbacks and vary the lot size on property located in an R-5 zoning district at One Sunset Circle Map 64 Panel 3 Mashpee, MA. Attorney Devin Kirrane and David S nicki ofCape & Islands Engineering represent the petitioner. Mr. Kirrane informs the Board that the Clermorrts are the current owner of record and that the purchase has gone through. Mr. I irrane further informs the Board that the Petitioner has worked closely with the direct mutters (the Shaw"s to work out a mutually agreeable situation, thus the previous continuance. Mr. Shag addresses the Board as well. I�e felt that since he had to adhere to strict zoning when he built his house that it was only fair that the Clermonts should as well. The Clermonts have moved some things around to suit everyone's wishes and Mr. Shaw wishes to express his support for the proposed construction. The Board thanks Mr. Shaw for working everything out before the hearing with Mr. Clermont. The Petitioner is seeking to demolish the existing house and replace it with a 2. /2 story louse with the same number of bedrooms . The � Y Y k
