So moved. <br /> Stephen Curtin: Requests a variance from Section 174-31 of the ZoningBy-laws to <br /> vary the front, side and rear setbacks in order to accommodate an in-ground swimming <br /> pool approximately 16' x 32' on property located in an R-5 zoning district at 39 Fox Hill <br /> Road (Map 21 Marcel Mashpee, MA. <br /> Sitting: Robert Nelson, Zella Elizenberry and Jaynes Regan. <br /> Mr. Steven Curtin represented himself at this hearing. He is requesting a variance in <br /> order to install a 16' x 32' inground swimming pool. He needs a variance of 20 feet in <br /> the rear and 10 feet on the northerly side. The Board will need an updated site plan from <br /> n engineer. Mr. Curtin agrees to provide this before the decision can be filed. The <br /> Board notions to grant these variances to Mr. Curtin. Criteria <br /> to include # 1, 2, 3 and 4. <br /> Mashpee Commons L.P.: Requests a variance from Sections 174-28, 1'74- , 174-3 1, <br /> 174-45.1 1n order to construct a building containing 38,500 square feet on property <br /> located in a C-1 zoning district at 3 8 Nathan Ellis Highway (Map 74 Parcel 20 <br /> Mashpee, IA. <br /> AND <br /> Mashpee Commons L.P.: bequests a Modification of a Special Permit (SP-86-04-024) <br /> filed with the Town Clerk on July 10, 1986 granting the Applicant (formerly known as <br /> Fields Point Corporation and now known as Mashpee Commons Limited Partnership) the <br /> right to operate and build a retail/office/restaurant and residential complex. Applicant <br /> now seeks to make minor revisions to said Permit to address actual built conditions, <br /> relocate certain square footage of building space and the location of parking areas and <br /> previously approved residential units. The proposed minor changes will not increase the <br /> authorized square footage allowed under said permit and will not be more detrimental t <br /> the neighborhood. <br /> Sitting: Jaynes Regan, Zella Elizenberry and Robert Nelson. <br />
