t <br /> Mashpee Zoning <br /> Board of Appeals Minutes of March 12, 2003 <br /> 6 <br /> SPECL4L PERMIT <br /> Douglas Storrs, vice President of Mashpee Commons, LLP represents petitioner. They <br /> are seeping to move forward with the next phase of building in Mashpee Commons. The <br /> original Special permit granted was Sp - -024 and revised again in 1999 specifically <br /> Sp-99-1 and Sp-99- 9. This permit granted the applicant the right, with certain <br /> condition, to operate and build a retail/office/restaurant and residential complex. The <br /> applicant now seeks to male minor revisions to the above referenced special permit t <br /> address actual built conditions, relocate certain square footage of building space and the <br /> location of parting areas and previously approved residential units. Such minor changes <br /> are permitted under C-l zone of the zoning by-laws and does not increase gross square <br /> footage previously authorized under the existing permit. These proposed buildings will <br /> result in an aesthetically pleasing plan and is therefore not detrimental to the <br /> neighborhood. Adequate parking has been addressed. Given all ofthis information, <br /> applicant is seeking specific approval of buildings 1 , 16, 12a and 29 as referred to in the <br /> plans submitted to the Board. The Board and Mr. Storrs review the architectural plans <br /> and converse back and forth in detail regarding these plans. The Board seers pleased <br /> with these pians and has no problem with the Special permit application. <br /> Mr. Storrs next presented his application for 2 variances that are needed at this time. He <br /> has In informed that a variance is necessary since there is less than 20 feet between the <br /> separation of two of the aforementioned buildings. The other variance deals with the <br /> height of the building. Mashpee Commons is requesting one of the buildings have a peak <br /> of 45 feet which needs a Variance since the height limit is 35 feet. Section 174-30 refers <br /> to distance between accessory structures. The Fire Department needs to be sure that they <br /> have 20 feet for their largest true to gain access. Deputy Hamblin sent over a memo <br /> indicating that he and the Chief met with representatives from Mashpee Commons to <br /> discuss the concept of increasing the building height on some of the proposed buildings. <br /> Some of the requests were acceptable, however, no specifics have been put in writing. <br /> Since these issues could pose significant fire prevention and suppression Deputy Hamblin <br /> and Chief Baker have requested the variance issues be tabled at this point until specific <br /> details have been addressed and put in writing. with that being said, the Board feels it <br /> best to follow the Fire Department's request and wait until these things have been done. <br /> The Board requests a letter from the Fire Department stating that he is In agreement with <br /> Mashpee Commons for the requests by Mr. Storrs. Mr. Storrs agrees to deliver this letter <br /> before his variance can be heard on April 91h. <br /> The Board moves to grant the Special permit to Mashpee Commons. The notion is <br /> seconded. So moved. Criteria to include same as previous Special Permit.
