CFB: "He does not mention -the level in the system?" "In other words, to him, as
long as it vas not coming up over the top, it was alright?"
Mrs. O'Neill-, "He was looking for the run-off."
"Where's the letter from Heufel.der, how do you pronounce his name. Did Mr.
Heufelder speak to you at the tatme he came out?"
Mr. t Neill: "yes, I called him, to have hien come out.
TC: "arid ah, did he tell you that you haide a failed system., do you recollect that?"
Mr. O'Neill: "Yes he did."
C: "Al.rig-ht,, did he tell you that your system should be renewed, or replaced or,
r va.ted or however elso-he might ".gave descr1.' ed. .t.;,f#
o' Te'Ill.: tries, and he explained to me the different things he felt that could
be needed."
TC-, "Could be done. . ,,yuh, did he ah, did you show him,-.plans that Down Cape Engineering
had prepared, did he agree that those plans were consistent with his understanding of
Title V. that would bring it up to complince?"
Mr. O'Neill: rt es based on 10C gallons per day, per bedroom, being a, three bedroom
house, that it exceeds it about by about four gallons."
C: "Let me ask you this question now, Mar. Heufelder told you the system had failed
it appears that Mr,, Labute to .d, your parents that back in Oct of 1983 that the system
failed, and it appears that Mr. Moniz,, I believe- -it was-.Lmither it October or November
of 183 indicated that the system had failed or needed to be -replaced,. Is it your
position today, that the system does not have to be replaced or renovated?"
Mr. O'Neill: "Not at all, what we are saying is that we would like to being this
ahem with dans to bring it up to Title V,, according to Mr. ala t s plans but he
is a Civil Engineer and we believe that his plans are sound and according to Title V.
And, we'd like to go mead w . his plans."
C: "Alright, then you'd like to use his dans, are you asking the Board to grant you
the Board of Health, to grant you a variance from their requirement which exceeds Title
` v requirements?"
Mr. O'Neill: "Yes,r
C; 'That's something that fh i s Board has the power to do if it chooses to do so, -it
has the discretionary poorer to grant a, variance from the requirements set forth both
in Title V and under their awn local control and I tri not sure that I have it clear in
my mind., Mr, Chairman, what that requirement is over and above Title v is, I know
that Mr. o a.la tells us that he designed the system to comply with Title V and he
believes it does comply with Title.V. It does comply with Title V but fails to meet
the local requirements,"
CEL: `I f I could have my Clerk.*.. ....
M; Local requA re ents, where we're in a water table problem."
TC: " h aarli e, maybe you could ah,...."
