T,C.: "We have a notice, l thank it only fair to state to Mrs. O'Neill and her�son who just arrived, that prior to your arriviiag, we had started this hearing and the purpose bf this hearing is to afford an' opportunity to you the addressee of the order to show cause why the order should not be en- forced by the Board of Health, that is to set forth any facts or reasons why the B should modify their order or hold it in abeyance, to suspend it or modify it or rescind it, because the has the pager to do any of these things I've just suggested, ah, 'n the event that evidence is presented -to the Board indicating that they should do this, what we're doing, what we've been having is a -g ne a.l discussion., l've been calling upon everybody here to tell the Board what they know about the situation and all, so fay* Mr. Labute had indicated that in October of 1983 he went down and examined the system and furnished an estimate to correct it with a suggested procedure to be followed that he recorrended to cure the problem and that in October of 183 when he was there he found the cesspool or the septic system overflowing on the ground that it was actively rLuming and he dug a hole in the ground, l don't know how deeply but he noticed a lot of wood laam,, he suggested it had to be located in n area where there was sandy soil.. Ah, your neighbor is here, and he has testified ih at he has not detected any odor coming from this property nor has he seen any problem A th the septage system in the length of time that he has lived there, there's a. vacant lot, then his hcu se is newt to you. T.C. : "And Mr. Na.la is here from Down Cape Engineering he testified that his brother designed a system and sent a letter to Ir.-Thil bits who told u about that letter, I believe that's what h was relating when you first came in and prior to that he indicated that he had submitted a design his firm had and sent a design up to the H to bring the system into compliamee of Title v, but the Board required additional infortion or to be sh i i on the + plan and made that known to him and that 'she had contacted., I believe it was Mr. O'Neill and made this known and ah,, '-in a .-endeavor to'secure permission to do this extra work which would involve an extra cost but that as of today he harL not received any authority o go forward and do this work which he was requested to do by the Board of Health.
