CFB recalled plans that this Board reviewed last week for land that <br /> was located behind Kellinui and Mundt (Great Zeck edbrook Rds. ) for Desoto <br /> Trust, this land is a possibility and he noted that the Treasurer had been <br /> researching this land for tax taking. <br /> 17 . 'down Counsel arrives. CFB asked whether or not anyone had seem the <br /> article by selectman Leonard Costa in the Falmouth Enterprise, re: Board <br /> of Health that is elected and its' problems. This article was followed <br /> .4 <br /> up with an editorials indicating it might be true and perhaps its healthy. <br /> Town Counsel thought it appropriate to send a letter to the Enterprise <br /> indicating that the lashpee Board of Health is totally independent from any <br /> other Baords and the function is for members to use their own indepent judge- <br /> ment <br /> and if that brings the B into conflict with- other Boards then. so be l l.it <br /> "Apparently what Costa is saying is that the Board of Health is a rub- <br /> ber stamp for selectmen, that selectmen should control the BofH. " <br /> 1 . Town ounsel ' stated that he did not deem an Executive session necessary <br /> for the following portion of the meeting. <br /> Town Counsel: "For the purposes of the record, I will briefly review <br /> what brought us up to this stage here. If you' ll recall. several weeks acro <br /> I ' not sure when it was) , the Board of Health was served a summons, which <br /> was addressed to the record Keeper of the BoH, calling in a croup of tapes, <br /> I believe it was nine or ten (I 'm doing this from memory, I don't have a copy <br /> of that darn subpoena here now) . In any event I clot a call from I onie tellin� <br /> ane she'd received this and asking e what she should do and I told her not to <br /> do anything until such time as this could be presented to the Board,, 'just to <br /> sit on it until. the Baord had an opportunity to review this; the Board did <br /> this (review) and determined that it didn ' t want to turn over all of these <br /> records, records of the minutes to the State Commission unless or until there <br /> was some assurance that there was some guarantee that the integrity of these <br /> tapes were reserved and also that the Board could het a copy of the tapes, <br /> because this represented the only records you has that were verbatim of <br /> those meetings and as I understand that from time to time or quite frequently <br /> you go back and listen to a tape if somebody comes in and says that the <br /> Board said they were going to do something, or, if someone comes and says <br /> they denied saying something at t'. a particular meeting, it affords you the <br /> opportunity to correct or amend your written minutes, otherwise to verify <br /> there and substantiate therm, it ' s my understanding the that the Board felt <br /> very uncomfortable, as a Board, letting these records -go because you'd lose <br /> a valuable source of information. well I paused this information on to <br /> Mr. Hughes in an endeavor to convey to hire, bent over backwards to convey <br /> to him and I hope that I was successful, the impression that the Board was <br /> not saying to the state Ethics Commission, ' Te defy your order, you're not <br /> going to have copies of these tapes ' . What I indicated to him was that the <br /> Board would very happily supply these tapes, if we could be assured that we <br /> have a copy here and he was invited to come clown and sit here in the Board <br /> of Health office and sit here and listen to the tees, that was an offer I <br /> extended to Mr. Hughes. Mr. Hughes felt this would be inconvenient, that he <br /> wanted the tapes up there, so I thin said to him, how about you making a <br /> copy of the tapes at the expense of the Commission of the state and take a <br /> W <br /> opy with you brie some reproduction equipment with your you know we don' t <br /> he type of equipment available to us to make a tape from a tape, e just do <br /> not have that, I know that such equipment is in use. He agreed that such <br /> equipment is in use at their office, that they didn 't have it but on one of <br /> the floors of the building where they are located. ONe Ashburton Place,, they <br /> do have this facility and he did have access to this and he could do this . <br />
