{
Page five
Board ofHealth-,,,' 4eeting, Minutes, January 28 , 1985
TC: They are public property to the following extent: they are part of the
overall record of the office, they are not the official record, they are for
use by the -Board only, however, they' re in existence though, they do exist
and as such they are physical evidence.
I
CHL: Joe, you've brought it out very nicely, there ' s nothing we are trying
to hide, you've been at many of our meetings, but the thing is the war hese
people go about it. In my opinion this is the most unethical ethics board
I have ever seen.
TC: This is the war he sees it and he feels as though he has t listen to
thess records, he knows they ' re in existence, he feels it' s his duty to
Listen to the things that took place at these meeti.ngsand decide if there
is anything contrary to what he ' s been told. In my judgement I don ' t thin
he' s going to find anything. You 'have readily acknowledged the fact that
rou' re e 1 loy d by New seabur` r, perhaps you did sic n some permits, yes you
did artici ate -in some board discussions when it came up and that you were
wrong in doing so, you realize now and at the time you didn' t think~ that
you were wrong.
RLW: May, I ask a question, how did this core about
TC: That' s a very good question, Roy, I don' t know as if you 're ever going
to find the answer because that question was asked by Larry in my presence,
when I was up there with hire initially and he was very quickly informed that
is priveleged information that the source of the complaint or whatever is
Jbnot revealed and is never revealed and that is art -of the sealed Dart of
their records so apparently there is no way that that can be disclosed,
where the state Ethics Commission received their complaint was analagi ed
to .if someone turned you into the IRS, you"re never going to find out who.
CHL: Joe, I had some people look into that, it was an anonymous phone Call
and an unsigned letter.
TC: OK, and that went up to the Ethics Commission.
CF : May I make the motion that we take advantage of Joe ' s presence in
Boston tomorrow and ask hien to deliver the tapes for us .
RLw: I second that motion.
CFH: fir. Lawrence abstaining, Mr. Wilson and I are in agreement that we re-
ust that Mr. Reardon to deliver the tapes for us in Boston.
motion to adjourn at 7 :35 by RLw, second CFB.
i
Respectfully submitted,
Robert F. Tallent
i
