• <br /> Page four <br /> Board of Health, Meeting, Minutes, January 28 , 1985 <br /> TC: As I 've indicated to the Board before the tape recorded proceedinqs <br /> do not constitute the official record of your meetings because you have <br /> t Adopted the taping proceedure as your official . , , .these are for your <br /> convenience, and for the purpose of refreshing your own recollection, for <br /> your own personal use, they do not constitute the official record, actually <br /> they are to assist the clerk in preparing the minutes of each x eetina. They <br /> i and of themselves are not the official record, there are a lot of etr�a- <br /> neous material, I shouldn't say material, there are a lot of extraneous <br /> co=.ents that are made at any meeting which would be ridiculous to have <br /> verbatim. A typewritten commentary that has no direct relevance to the <br /> issue before any body when its ' in the course of deliberation. very few <br /> bodies that I know of use a verbatim transcript of the minutes of their- <br /> meeting, they simply record the things that the law requires them to he <br /> recorded, specifically, members who are in attendance, motions that are <br /> rnade,the people who will speak on the motion, the recording of the vote <br /> in favor of or against the motion of the members, thereby recording the <br /> action adoted on the motion; they also record the requests that are made <br /> of citizens, petitioners or anyone who comes, you 'make' rote of that, Mr. <br /> So and so was here seeking this or that. <br /> Mr. Hughes knows that it exists and he has summonsed it in and I feel <br /> that we are under a legal obligation to comDly with it, the reasonable- <br /> ness <br /> easonahle- <br /> ne s of our position I think has been met by Mr, Hughes to make a replica <br /> of thea and if these don't come out I told him to come don any time he <br /> grants to, <br /> I tried to convey to him that this Board has nothing to hide, there ' s <br /> no fear here, we don' t have a Wa erg te. here with a Rosemary goods who <br /> is going to destroy the tapes or whatever. I sense... there may be some <br /> fear here that on the part of the investigator that we are contemplating <br /> doing this and as I pointed out as long as there ' s some rule of reason <br /> applied and the rule of reason is that we just to have those tapes avail- <br /> able, we don' t wart to send then up theme for six months. He will 'get <br /> our cooperation. <br /> CHL: what if they get lost, everybody who has seat something to the State ' <br /> never gets it back and I 'm serious . <br /> TC: I explained that to hira and I think he has bent over backwards to try <br /> and meet this objection that I raised on behalf of the Board, <br /> CFs : I have one question for you, who is the keener of the records , <br /> TC: The Keeper of the Records is probably the Clerk of the Board. <br /> CFB: so that then would he me, richt <br /> i <br /> TC: -Yes <br /> TC: You do not have to go up yourself, if they're delivered I can go u <br /> myself, as a matter of fact, I have to go to Boston tomorrow and meet with <br /> EE which is right next door to oe Ashburton Place, <br /> Lw: I wonder if he understands these tapes are public property? <br /> TC: oh gyres he understands that no question <br /> CHL: But are their public property � <br />
