TOWN OF MASHPEE <br /> r <br /> Board Of Appeals <br /> Minutes <br /> February 9 . 1994 <br /> The Mashpee Hoard of Appeals held a meeting on Wednesday, <br /> February 9 , 1994 at 7 . 30 P.M. at the Ma►shpee Town Hall . <br /> Hoard members present and acting throughout were Michael A. <br /> Makunas , Edward M• Govoni and Jamie Regan• Building <br /> Inspector William F. Hauck was In attendance . Mr , Makuna <br /> called the meeting to order at 7 : 37 i am* <br /> Donald H. Priestly and Dream D ire encs - Mr • Makunas <br /> announced that the Board did not have a quorum of members <br /> for these two hearings and they would be continued to <br /> February 23, 1994 . Mr . Govoni moved to continue the <br /> hearings . Mr . Regan seconded. All agreed. <br /> Fence E. and. Catherine E. Warner - Request a Variance <br /> from Sections 174-21 and 174-31 of the Zoning By-laws for <br /> permission to vary the lot size, frontage and setback <br /> requirements to allow construction of a new single family <br /> dwelling in an R-3 zoning district on property located at 7 <br /> Clover Dane (Map 117 , Block 125 ) Mashpee, MA. <br /> ` Members sitting : M. Mak nas , E. Govoni , J. Regan <br /> Attorney Kevin Kirrane represented the applicant and stated <br /> that there had been a question if a building permit could be <br /> issued. He explained that the applicants owned an adjacent <br /> lot with a four-unit dwelling which had been constructed S <br /> years ago . He referenced Willard vs. Orleans which stated <br /> that the vacant lot was protected and could be built upon. <br /> He said the vacant lot was larger than most of the lots in <br /> the area. The Variance request is for setbacks to conform <br /> with the norm in the area. <br /> Mr . Makunas noted that the Board had received two letters <br /> from abutters objecting since the lot was used for parking. <br /> r . Warner showed tax bills on the property and explained <br /> that people in the neighborhood had been using the lot for <br /> parking . Mr . Warner said they could accomodate parking for <br /> the four-unit rental and showed drawings of possible access . <br /> Bill Johnston, a neighbor, asked who received written notice <br /> and was informed that the abutters and abutters to abutters <br /> within 300 ' and asked about a Town Meeting article which <br /> changed setbacks . He was informed this was not passed. <br /> There was discussion] of parking problems . Dorothy 'Towne of <br /> Elliott St , stated that the traffic would be dangerous . <br /> Engineer John Slavinsky said parking was planned so that <br /> I <br />
