Norris Kirsner..
jig SHL: "I don't think you could have done that, you have to stay
a certain amount of feet off the building, you have also a leach-
ing with that so we put the tank off the building then to the
leaching field, which is the one coming close to your sideline.
Mr. Ki ner: I realize that. "
FB : " What we took into consideration as well, Norris, is that
the ground water flow is corning down this way, heading away f ror
your area - and it is not any closer to the areas belowhim. "
Mr. Kirsner: "I think it i_s, I .think for another reason too, for
this reason, and you know you and I have had many chats before so
you know I have high respects for the Board, but, I also have high
respects for ray own primary- interests. "
CHL: "Didn' t this go in' front of. .d.idn' t this go back to DE E F-
just because it' s an update we don't have to go to E. "
Mr. Kus er: I"You go back to DEQE for the purpose of getting
your variance from the 100 ' minimum requirements, that' s when you. . .
CHL: 'trot on an upgrade ! "
FB* "We never, we never go, we just don' t if it' s a new .property. "
Mr. irsner: '.'I know, but the fact of the matter is, (interrupt)
FB: " n upgrade usually what we 're attaining when we upgrade a
system, is a greater security than what we had when we started. "
Mr. K i r ne r; "I spoke to DEE, and uh, whether it be an upgrade or
otherwise, they don' t permit variances to be granted excepting
through their department before the local B H can do 4it, so the
fact that its ' an upgrade, - I think (interrupt)
CHL: "we 've been led to believe the other- way: . (interrupt)
Mr. Kirsner: "I know, I 'm not being- critical, in fact I accept
your statermentthat you were led to believe otherwise , but, I think
that, I think it' s fairly clear that any variance would require
the approval of DEE, before you could do it, whether it be an
upgrade or otherwise . I can understand (interrupt)
CHL: "See we don ' t agree with you on that, because of what they
have said in prior conversa-tions with then, alright, it wa o
new construction, period, I mean, they didn't, they didn't. want
like anytime you were upgrading, now they did not want to get
notified, I don' t .know if I 'm saying this right, back to, God .it
was a few years back, but it was the last time I remembe.rF it
being brought up. "
Mr. irsner: "You know nobody' s going to question you, the vor
ac.ity of what you say, except the law is otherwise. "
i
CHL: "That ' s, that ' s, I don 't know unless I went and, and, and y
looked it up again, you know, ask there to dive it to us in writing
if they would give it to us in writing, thea we would stand by
what they would give us in writing, up to right now, prior con-
verations with them in this building on more than one ocassion
this same thing has been -brought up, because you're not the
only one that' s come up before us, it ' s come up many tines and
we have the right according to them to give this variance with-
out notification to therm. That-Is the way we are under the under-
