<br /> a certain amount of feet off the building, you have also a leach-
<br /> ing with that so we put the tank off the building then to the
<br /> leaching field, which is the one coming close to your sideline.
<br /> Mr. Ki ner: I realize that. "
<br /> FB : " What we took into consideration as well, Norris, is that
<br /> the ground water flow is corning down this way, heading away f ror
<br /> your area - and it is not any closer to the areas belowhim. "
<br /> Mr. Kirsner: "I think it i_s, I .think for another reason too, for
<br /> this reason, and you know you and I have had many chats before so
<br /> you know I have high respects for the Board, but, I also have high
<br /> respects for ray own primary- interests. "
<br /> CHL: "Didn' t this go in' front of. .d.idn' t this go back to DE E F-
<br /> just because it' s an update we don't have to go to E. "
<br /> Mr. Kus er: I"You go back to DEQE for the purpose of getting
<br /> your variance from the 100 ' minimum requirements, that' s when you. . .

<br /> FB* "We never, we never go, we just don' t if it' s a new .property. "
<br /> Mr. irsner: '.'I know, but the fact of the matter is, (interrupt)
<br /> FB: " n upgrade usually what we 're attaining when we upgrade a
<br /> system, is a greater security than what we had when we started. "
<br /> Mr. K i r ne r; "I spoke to DEE, and uh, whether it be an upgrade or
<br /> otherwise, they don' t permit variances to be granted excepting
<br /> through their department before the local B H can do 4it, so the
<br /> fact that its ' an upgrade, - I think (interrupt)
<br /> CHL: "we 've been led to believe the other- way: . (interrupt)
<br /> Mr. Kirsner: "I know, I 'm not being- critical, in fact I accept
<br /> your statermentthat you were led to believe otherwise , but, I think
<br /> that, I think it' s fairly clear that any variance would require
<br /> the approval of DEE, before you could do it, whether it be an
<br /> upgrade or otherwise . I can understand (interrupt)
<br /> CHL: "See we don ' t agree with you on that, because of what they
<br /> have said in prior conversa-tions with then, alright, it wa o
<br /> new construction, period, I mean, they didn't, they didn't. want
<br /> like anytime you were upgrading, now they did not want to get
<br /> notified, I don' t .know if I 'm saying this right, back to, God .it
<br /> was a few years back, but it was the last time I remembe.rF it
<br /> being brought up. "
<br /> Mr. irsner: "You know nobody' s going to question you, the vor�
<br /> ac.ity of what you say, except the law is otherwise. "

<br /> looked it up again, you know, ask there to dive it to us in writing
<br /> if they would give it to us in writing, thea we would stand by
<br /> what they would give us in writing, up to right now, prior con-
<br /> verations with them in this building on more than one ocassion
<br /> this same thing has been -brought up, because you're not the
<br /> only one that' s come up before us, it ' s come up many tines and
<br /> we have the right according to them to give this variance with-
<br /> out notification to therm. That-Is the way we are under the under-
