<br /> CHL: "But I leave that up to the Chairman, that' s the Chairman,

<br /> Mr. Kirsner: "I know that, you may have acted, and I 'm not ay-
<br /> ingyou didn' t. . (interrupt) . 11
<br /> CHL:. "We 've acted in all good faith. "
<br /> Mr. Kirsner: "I said you acted in good faith, I think I prefaced
<br /> it-.originally with that particular remark, but, I 'm again tolling
<br /> you that it ' s my feeling that there was a violation of law, be-
<br /> cause -of the relocation of the septic tank, even though it' s an
<br /> upgraded situation, I think that -the DEQE should first have been
<br /> approached and asked, 'Can we give this variance ' , although you
<br /> tell ane the background of the situation is such, that you were
<br /> led to believe -that it wasn't necessary. I also believe that
<br /> tank is a structure, beneath or above the ground, and there are
<br /> specific laws that controls the location of these structures
<br /> either above or b low the ground. "
<br /> Lw: "we had that come up years ago, and .the Town Counsel at
<br /> that time, and that was Walsh and Judge staff made the ruling that
<br /> it was not a structure. "
<br /> Mr. Kirsner: "Dick Staff.?"

<br /> Mr. Kirsner: "Well, those are my views, very strongly! "
<br /> CHL: "Well, mote of your views, and as we say, . . . interrupt
<br /> Mr, I r ne r: "And furthermore, you know ah. . (interrupt)
<br /> CHL : "whatever the Board wants to do. "
<br /> Mr. Kirsner: "My position is this, I don 't want to attack the
<br /> Collins ' because obviously they relied upon the Stan who prepared
<br /> this. . . . (interrupt)

<br /> Mr. Kirsner: "And, ah, but I strongly feel, and that' s ghat I
<br /> came in to tell you, and also to be somewhat of a help in the en-
<br /> tire situation, really, that I feel that ah, there ' s been not
<br /> equal consideration being given to rye, and I wouls argue the same
<br /> point incidentally if it were your land, or your land, or your
<br /> land, or anybody else ' s land. And true it ' s an upgraded situation
<br /> no question about that at all, and true you acted most in good
<br /> faith, nobody' s going to fault with that either .because, why
<br /> shouldn' t you, there ' s nothing for you to gain by not acting in
<br /> good faith. But, by the same token, try to understand ray point
<br /> of view. "
<br /> CHL: "I understand, I 'm not darning your point of view at all. "
<br /> Mr, Kirsner: "I 'm the man who is primarily affected, I am con-
<br /> cerned, perticularly of the water problem. . rater upt
<br /> CIL: "The thine that bothers re that you're not being shown on
<br /> there, there' s no way in hell we know than you are there . "
