<br /> 2. Motion by Charles Bucking&n n to accept minutes of meeting 2/24/87, Second, Mr. Wilson. So voted.
<br /> 3. W. Buckingham so noted that John P. Slavinsky was present upon request of the Board to present
<br /> the plan of Cape & Islands' Surveying for %11 oy, 155 Whippoorwill Circle. Other interested parties
<br /> in attendance were John Varkonda %shpee Conservation Officer), Cobert Bu rg mnn (Holmes & McGrath)
<br /> who represented the abutter to the north, Susan & Kenneth Konikowski, 155 Whipp rwill Circle.
<br /> Mr, Buckingham: And we had requested a meeting with the engineer, W. Slavinsky fpr plans for
<br /> W. Nva l l oy, 166 Wh i ppoor i l 1 Circle, we requested the Conservation Officer be here, John'.

<br /> W. Sl av i nsk,y: Whem do we start, at the beginning?
<br /> CFB: I think we have to start at the beginning,, becasue if I renter correctly, we had refused t
<br /> accept the plans because of the distance from the wetlands.
<br /> JPS: OK, we started off with Mr* Malloy, we did a plan of the lot, submitted it to 0onservation,
<br /> a different house, a different location, Conservation disapproved,, we appealed it t :�the State,
<br /> DEQE made a site visit; at that time they suggested, a mng other things that we check with an ex-
<br /> pert, or, experts the actual location of the marsh. ' Step nor two, Mr. Ml loy hired Bob Oran,
<br /> and Dario DeGregorio of SABATIA, they came down and did a study and located the edge of the marsh,
<br /> which is the way it is shown on this plan. Mr. M61loy changed his house, rmoved it forward, at such
<br /> time they did that, the pero 1 at i on gest had exp i red, which was done the first t i rye with Ws. Ander-
<br /> son, the second time with Judy Giorgio. We submitted it to Conservation, Conservation tumed it
<br /> down again, we appealed it to the State, the State issued a superseding order. At all the sane
<br /> time there was also a dock i n vo 1 ved here which was a 1 so tumed down by the local ; nser v at i on Cm-
<br /> mission, and a superceding order was issued by the Mate, the say it's changed the way it is now,
<br /> is that the second Conservation hearing, a lot of the abutters were there and ah, because the sys-
<br /> tErn is going to be sitting above the existing ground, we have to rive all the impervious-and
<br /> claymaterials within twenty five feet of the l each i ng facility., a pont i on af that about six feet
<br /> of it extended on to the lot to the south, a Mr. Kaufman, I believe that's his lot. He didn't seen
<br /> to rind to object, he didn't object at all,, as a matter of fact that there was a house being built
<br /> there. When the plan came back from the Board, that was one of the problem that we were going to
<br /> excavate onto abutting property, apparently there-are some objections there, since the planhas
<br /> been changed, thea is no excavation involved on anyone's particular lot; them is however a need
<br /> to remove any impervious material that is theme on Whippoorwill Circle. The house is being built
<br /> on a pier foundation, that was also suggested by DEE and a far as they were concerned, we didn't
<br /> have to conform to any setbacks for foundation, if a house is being built on piers. The second
<br /> time that this particular proj e t was appealed Liz Kou 1 oheras rade the site visit,, there's been
<br /> two people from DE E, two different hea 1 th agents from the Mashpee Board of Health here, it's been
<br /> filed with 'Conservation twice, it's been issued a superceding order by DEE once- and the last time
<br /> in reference to the letter f ram the Board of Hea 1 th. The pr ob l ems we had were
<br /> (1) The Board wanted a 2000 gallon tank
<br /> CFB: And that would have to be weighted. Ya
<br /> JPS: Yeh, so we did that, uh, the Board wanted not to excavate onto anyone else's property, whcih
<br /> was mainly Mr. Kaufman, so we've taken care of that, I be 1 i eve it's up to Mr. Iiia 1 l oy to supe l y th i s
<br /> Board with some kind of written, proven, easement that he has the right to excavate on Whippoorwill
<br /> Cir 1e, such excavation would amount to approximately to the edge of the pavement, if in fact there
