<br /> JPS: We've got the four feet of natura l ly occuri ng pear i ous materi a l, it's in the groundwater, so
<br /> what we've got to do is rove ourself four feet above that, when we do that we came up above ground,
<br /> so naturally we've got to fill that, we've got to remove all that material and then fill it in, wbat
<br /> we're doing is filling in a front yard and I don't think it's a lot different than what has been
<br /> done in the nighborhood in those lots particular abutting, in the past, except that these were done
<br /> obviously a while ago. But as far as any excavat ion, any filling, any work at all on the actual
<br /> private abuttiM lots, there isn't any involved.
<br /> CFB: so you're backing off on them. conservation.
<br /> Vary onda: John's quite right, it has been before us a nunber of times, we have ah, the omission
<br /> almost sus to have'Zonsistently turned it down and DEE has superceded it. Essentially, there
<br /> are some pool ems that the conerrati on ccmi ss i on has had wi th th i s house., it i s on a marsh, and
<br /> if ,you look at the plans, you'll see the edge of the water is right along the marsh 1 i ne. and now
<br /> something that obviously will not came up before this Board, but the Town of %shpee does have a
<br /> fifty foot set-back from the edge of the wet I and, adn it does require a variance, but that's not a
<br /> matter for; th i s Board. I have some pictures that were talen and perhaps, my, b i gge st concern is the
<br /> fact that this lot, and I have pictures of it, is consistently innunJated by water. Although
<br /> I have not seen it, supposedly during a storm tide, ,you would have a strong ori-shore wind, this
<br /> lot is flooded almost to within seven feet of the road. Now again,, I don't have pictures of that,
<br /> it's what I've been told, by people who have lived thea much longer than I have, I do have pic-
<br /> tures though , I can show ,you some of the water and these are perhaps the two best, right thea,
<br /> ,you can see the water obviously going up and I have located the cedar ,you see there on the map,
<br /> arxd it is appro imt l r 97 feet back from the edge of the house, or right about the riddle dry
<br /> well in the back of the house, right about here, now that was during high tide. Now again .the
<br /> commission is concerned about the possibility of groundwater pollution, what is going to happen,
<br /> are we g ping to have nutrients migrating with the ebb and the flow of the tide, in and out, there
<br /> is just gu i to a nuTber of concerns. Another concern is water, again I think this is something the
<br /> Board will look at, his well is located within the salt marsh, It just doesn't somehow, the lot is
<br /> a very difficult 1 of, and I think the Board should look at it very, very carefully., taking into
<br /> consideration the water does come all the way onto the lot. Are they going to get potable water
<br /> n the I of, these are some of the things I wish the Board would look i nt o, or, ,your know, keep in
<br /> mind as they`re mak i rig the i r deo i s i on.
<br /> DFB: Well, them has been4a lot where their well was within a seemingly reasonable distance of
<br /> salt water, interfacing that.
<br /> JPs: If I might say, directly next door;, I'm not sura who owns it naw, lout I believe it was for-
<br /> merly Ryan, those l l s'a're in the rear, that's an exi sti n9 wel I, that's the scale, that's where
<br /> it is.
<br /> CFB: Yeh, I realize that, one of the needs that would have to be Bret by this Board is to show
<br /> that thea is some, a well, in the proposed place and that well cones up with no chloride, no salt,
<br /> because it might be very possible that this other well is pulling decent water and for.sone reason
<br /> or another you can't find it here.
