This p l ars was previously reviewed <br /> by the Board and denied without prejudice however, Attorney Toomey cited the wording of the Board's <br /> regulation and the wording "FROM THE MEAN H I CH MATER MM" <br /> Mr. Slavinsky advised the mwbers that the State had issued a Siperceding Orden of Conditions, and <br /> he introduced Chris Toomey as representing Mr. Malloy. <br /> Mr. Topme : "The State Env i manta l Code says. that, it def i nes a watercourse, as including a marsh-- <br /> land, <br /> arsh-land, but, it also indicates that in measuring it has the sane footnote as the %sh pee By-Law which <br /> says that in measuring d i stance, ,you measure from the mean high water mark not from the edge of the <br /> wetland, whclh would made sense because the mean high water nark is where ,you're going to get the <br /> tidal action and although there may be water in the wetlands at certain periods of the year, it' <br /> not going to be there all the t i rye and Mashpee has adopted the standards that have been set forth <br /> in Title V, they've just changed the d i stances on some Of these things. But,, the footnote #2 t <br /> your regulations is identical to the footnote 2-of the State regulations indicates that all dis- <br /> tances shall be measured from the average mean annual flood elevation i n i n l and areas and from the <br /> rean high water in coastal areas. This'is a coastal area. So. what John has shown on the plan is <br /> that are we not only SO feet from the mean high water line which is requ i red by Title V, but, we're <br /> 100 feet from the high water line as required by Ma.shp e BOH regulations." <br /> Chair.- That, rgur l ati on a 1 s ment i ons 'flood'. <br /> Atty..
