He stated, in <br /> speaking with D.E.Q.E. ,their comments were tore-perc, re-perc with <br /> revised plans or to validate the permit due to the recent inspection <br /> by the engineers. <br /> Mr. Costa and Mr. relish requested Mr. McQuaid to' request in writing, <br /> .an opinion from Town Counsel , as to -the legal status of the permit. <br /> 11 . ) 205/312 Hoopho le Road, (Hendricks) for St i g l e­ Mr. <br /> McQuaid informed the Board that upon inspection of the septic pit, it <br /> was found to be in failure. He explained that the system was installed , <br /> in 1973 <br /> Mr. reelish- motioned to grant permission to upgrade/repair. the septic <br /> Sys em for lot 205/312 Hoophoie Road, Mr. Wilson seconded, all agreed. <br /> APPOINTMENT: Dr. Fanous/Mr.- Barr re. <br /> Complaint 1 2 Spoondrift Circle <br /> Dr. & Mrs. Fanous and Attorney Devin Kirraine,, representing Dr: <br /> Mrs.. Fanous were in attendance for this scheduled appointment. ' <br /> Mr. Costa explained that this appointment is in reference to a com- <br /> plaint that the abutting lots septic system is located on their property, <br /> as illustrated on a submitted registered plot plan. Mr. Costa commented <br /> -that it is the installer' s responsibility -to install. the system on the appro-- <br /> Priate lot. <br /> Attoney lei rra i ne informed the Board that the property is land courted <br /> i property and .a person cannot obtain adverse possession rights on land that <br /> has been land courted. <br /> Dr. Fanous-;. stated he would like the system removed and would not con,- <br /> sider and easement. <br /> Mr. Costa requested Mr. McQuaid to inform Mr. Barr that under current <br /> Board of Health regulations the system, belonging to Mr. Barr on Dr. Fanous' <br /> property. i s to be removed. <br /> W <br />
