EAM asked the Board to note <br /> his letter to Halpern in this regard. #EAM asked that <br /> Tarabelli get his license before he pulls the repair permits. <br /> Tarabelli agreed and stated this will not happen again. <br /> APPOINTMENT: ROBERT BER MAN (HOLMES & MCGRATH Revised Sep- <br /> tic plane for Apleyadi, 12 .,.Kim .Path. Bergman informed the <br /> Board the variances had previously been granted by this Board <br /> and approved by the D.E.P. for slope setback, containment <br /> gall and property line setback. Also Conservation had ap- <br /> proved the plans and issued an "order of Condition' . A very <br /> unusual <br /> occurrence happened in that the State D.E.P. Division of <br /> Wetlands reversed the local conservation commission's ruling* <br /> Bergman informed the Board as to why the septic is proposed <br /> to be installed behind the house and that Mr. Appleyard had <br /> approached the two abutters who are on private wells and of- <br /> fered to pay for their water hookup to f ac i'l i tate perhaps a <br /> more favorable septic location, however, they refused his of- <br /> fer. The State is opposed to the retaining wall because of <br /> its proximity to the dune and is opposed to bringing in fill <br /> to adequately cover the system, Bergman suggested to the <br /> State that instead of a concrete retaining wall he would pro- <br /> pose a polyethylene sheath which would serve the same pur- <br /> pose. Bergman suggested that perhaps the groundwater adjust- <br /> ment policy may not be required here. Bergman had adjusted <br /> the groundwater 1 .8 feet based on the Truro well and said <br /> that according to Brian Dudley and Firman of the DEP there <br /> is no need to adjust within 300 feet of the ocean as long as <br /> there if 4 feet of permeable material below the leaching fa- <br /> cility. If this is allowed them he could do away with bring- <br /> ing in fill and the retaining wall . OOE questioned whether <br /> the tidal action affects the observed groundwater elevation <br /> and suggested an observation hole be dug to monitor this pos- <br /> sible effect for a period of 24 hours. Since freshwater <br /> floats above saltwater if there is significant tidal action <br /> and it affects the groundwater elevation, it may cause the <br /> system. to be in failure during high tide. B G asked that an <br /> observation well be ,installed as suggested by OOE and monitor <br /> the groundwater elevation for 24 hr . EAM noted that we did <br /> hold a public hearing the last time around and there were no <br /> objections from abutters, in fact we had to get a letter of <br /> approval from one abutter. Therefore, there is probably no <br /> need for another public hearing, The Board agreed that once <br /> e are satisfied with the groundwater elevation issue, this <br /> plan will not have to back to the State for approval. we are <br /> to be notified when the monitoring tabes place. Case contin- <br /> ued. <br />
