i <br /> R <br /> MINUTES c ok er 4 , 1990 9 BOARD OF HEALTH <br /> lip Attorney Henchy questioned the Board as to whether they <br /> would gine consideration to leaving the hearing' open and al- <br /> lowing him to see what D.E.P. would do on some sort of a <br /> tight tank and with the stipulation, upon the provision with <br /> public water, it would be disconnected and a 'title v system <br /> installed. <br /> Mr, Greelish stated he does not know what merit the ap- <br /> plicant would have on a continuance. We are unsure of the <br /> time frame in which D.E.P. would respond. We would prefer <br /> the applicant reapply. <br /> Attorney Henchy stated he has some other reasons in not <br /> wanting to do that in light of some new regulations that have <br /> just recently been passed. Attorney Henchy requested con- <br /> tinuance to a date certain, eight weeks from now. <br /> Mr, McQuaid stated the maximum time allotment would be <br /> 45 days. <br /> Mr, Costa stated he would agree with Mr. Greelish that <br /> the applicant should reapply. The applicant will be required <br /> to reapply with revised plans anyway. <br /> Mr, McQuaid stated, as he understands _this Board,, the <br /> plans are unacceptable. Comping hack with a plan for a tight <br /> tank, and if you know that something is coming down the pike <br /> from D.E. # than you are not being quite fair with everyone <br /> present. To ask for an indefinite postponement does not show <br /> goad faith on your part. <br /> Mr, Costa stated he does not want to mislead the appli- <br /> cant by agreeing to continue something that is unacceptable <br /> to this Board. <br /> Attorney Henchy stated part of the consideration obvi- <br /> ously, <br /> bvi- <br /> ously, is that if your turn it down I am going to appeal and <br /> is an additional expense, <br /> Mr. Greelish stated this is an issue of fairness to come <br /> back, revisions would be required. Abutters should have the <br /> opportunity to be notified by due process. <br /> Attorney Henchy questioned whether a reduction in the <br /> number of bedrooms would make any difference to the Board. <br /> Mr. Greelish Stated no. <br /> Attorney Henchy stated he would ask the Board to con- <br /> tinue this for 45 days, If you are not inclined to do this <br /> T <br />
