MIAUTES May 25, 1989 2 BOARD OF HEALTH <br /> . Memo from J. Murphy e: Recycling - Mr. Costa nominated Mr. Greelish <br /> to serve as the Mashpee representative for the D:#E.Q.E. study of re- <br /> cycling options for Cape Cod, Mr. Doherty seconded. <br /> . Copy of letter to DiMaggio re: Landfill contract and change order - <br /> Mr. McQuaid informed the Board Mr. DiMaggio did raise questions regard- <br /> ing the completion of the final contract document, however those ques- <br /> tions should have been resolved as fir. Sipione did speak with Mr. DiMaggio <br /> on this matter. Mr. McQuaid stated there is an issue that remains, that <br /> being the necessary bonds and commented he spoke with Mr. DiMaggio's <br /> attorney who relayed that Ton Counsel h-ad determined that the Board of <br /> Health does have the authority to waive the payment bond part of the con- <br /> tract requirement. Mr. McQuaid explained that Mr. DiMaggio i s willing <br /> to supply a performance bond equal to 1 o %. of the contract price and <br /> commented,, Mr,. D i Magg i o _i s-:of the opinion that the payment bond should <br /> not be required. as he doe's not intend to subcontract out any of the work. <br /> Mr. Gree 1 i s h motioned -to waive the payment bond that is a--.-requirement of <br /> the landfill/transfer station contract with Mr. DiMaggio with the stip- <br /> ulation Mr. DiMaggio submit an affidavit - o this Board stating hi 'd.ih <br /> t6ntions and a letter from Town Counsel be secured stating Mr. eardon's <br /> opinion that this Board may waive the payment bond requirements, Mr. <br /> Costa seconded. Note: Due to .a confl-i t. of 'interest W... ,Doherty stated <br /> he will step down -for this gate. <br /> . Copy of letter from D.E. .E. to Mass Military- reservation : site <br /> assessments - The Board did not comment on this issue. <br /> 10. Copy of letter from D.E. .E. to Water Commissioners re: Approval of <br /> and for T-4 well site -J.Y. 1 -- The Board acknowledged receiving <br /> the. copy. <br /> 11 . Note; Duo <br /> to a conflict of interest Mr. Doherty stated he will step clown from <br /> this vote. <br /> APPOINTMENT: Discussion of Human Services <br /> Mr. Robert Connell , Director of the Council on Aging and Ms. Lynn Waterman,, <br /> Outreach Coordinator were in attendance for this discussion. <br /> Mr. Connell informed the Board he is here -this evening to discuss a method <br /> to ensure human_ services are provided to the Senior.. Citizens of this town thru <br /> the inter-service agencies funded through the Board of Health budget, principally <br /> the Visiting Nurses Association and the Center for Individual and Family counsel- <br />
